This is a different job. He has already undergone a background check, but he's now appointed to a new position and is subject to an update of that check, senate hearings and a vote.

a position on the UK attack. Being CIA director he sure as heck can't claim ignorance. His back fill will also be interesting. I see a narrative that is developing that should be exploited. Instead of the millionaire making generic statements about impeaching Trump, could he fund attack ads showing our historic relationship with the UK, and how our leadership has decided to abandon that in favor with our biggest post World War II enemy. Those ads should be running in every red district in the country.

The fact that a person occupies a position that required Senate confirmation does not allow that person to be moved into a different position that requires confirmation without going through the confirmation process again.

What may be confusing people is that a vacancy in a position requiring senate confirmation can be filled TEMPORARILY by the appointment of an already confirmed official to serve in and ACTING capacity. There actually are several ways the vacancy at State could be filled temporarily: by the elevation of the next most senior official (in this case, it's Deputy Secretary of State John Sullivan). Or it can be another confirmed official, but subject to 210 day limitation (with certain exceptions). And in some instances, there is a third option for a different senior official in the same department to be named to serve on an acting basis for 90 days.

In this instance, Sullivan is now the Acting Secretary of State, and Pompeo will become Secretary of State if and when he is confirmed by the Senate, notwithstanding the fact he already holds a position for which he was confirmed.

But the answer is that under the "Federal Vacancies Reform Act of 1998", the president can fill a vacancy with anyone who has already been confirmed by the senate for a period of 150 days.

So yes, he would require confirmation, but no, it doesn't need to happen before he takes office.

But his reconfirmation isn't necessarily a sure thing. The dems who voted for him the first time say they won't vote to confirm him to sos, and at least one republican is saying they won't vote to confirm. Add to that, 5 months from now is November. It will be an election issue. We may be able flip republicans afraid of his baggage.

So it isn't a sure fire deal he can be reconfirmed. Heck, 5 months is an eternity on trumps staff.
