WHEN he is charged with a crime (not "if" . He will be charged eventually. Only if he kicks the bucket first will he not personally be charged. Can you charge someone posthumously?

With any other crimes they uncover.
You investigate a robbery and find a dead body. NO FAIR charging me with murder since investgation was about robbery.
