In a written statement, the department said it conducted an exhaustive investigation of allegations brought to light by a Senate panel investigating the 2008-2009 financial crisis.
"The department and investigative agencies ultimately concluded that the burden of proof to bring a criminal case could not be met based on the law and facts as they exist at this time," the department said.
But the department added that if additional or new evidence were to emerge, it could reach a different conclusion about prosecuting Goldman.
A Senate subcommittee chaired by Sen. Carl Levin, D-Mich., in April 2011 found that Goldman marketed four sets of complex mortgage securities to banks and other investors but that the firm failed to tell clients that the securities were very risky. The Senate panel said Goldman secretly bet against the investors' positions and deceived the investors about its own positions to shift risk from its balance sheet to theirs.

This administration knows which side it's bread is buttered on. This is something I'd expect from a Republican administration and sadly, something I've now come to expect from a Democratic administration.

(8,360 posts)The legal odyssey of a former Goldman Sachs programmer, Sergey Aleynikov, took a surprising turn on Thursday when the Manhattan district attorney charged him with state crimes.
Mr. Aleynikov was charged in state court less than six months after a federal appeals court overturned his conviction on federal criminal charges that he stole secret source code from Goldmans computers.
While the case involved a relatively low-level ex-employee at a financial firm, the government has taken a particularly hard line. The district attorney, Cyrus R. Vance Jr., and Preet Bharara, the United States attorney in Manhattan, have made the prosecution of corporate espionage and high-tech theft a top priority.
This code is so highly confidential that it is known in the industry as the firms secret sauce, Mr. Vance said Thursday in a statement. Employees who exploit their access to sensitive information should expect to face criminal prosecution in New York State.

(1,881 posts)Everything got deregulated. Glass Steagall was repealed. The financials were given a free ticket to ride. The only thing we can do is regulate the hell out of them. LIBOR, on the other hand, is far more easily prosecutable.

I used to think Rahm Emanuel was the worst appointment Obama ever made but I think I was being unfair to him.
Won't prosecute Wall Street crooks, won't go after the war criminals from the bush administration, won't do anything about the voter suppression measures enacted to get his boss voted out of office.
But he sure has time to go after every medical marijuana dispenser he can find.
If Obama gets reelected he needs to throw this POS overboard first thing. I guess it's too late to do anything about him in this term.
