Granted, on the basis of following the law and constitution, Tiny doesn't have a leg to stand on. But he and his fellow gopers control the government and they'll most certainly make things exceedingly difficult for any asylum seekers. These people are poor, so they'll have difficulty finding representation, Tiny will just have to wait them out and he wins.
