“Voting by fax or email is not an option under the Executive Order,” the Florida Department of State stated in a news release that accompanied Scott’s order. “In the hardest hit areas, communication via phone, fax and email remains challenging and would be an unreliable method for returning ballots. Additionally, past attempts by other states to allow voters impacted by natural disasters to fax or email ballots have been rife with issues.”

But Andersen contended that when the order was written, “no one knew the amount [of damage]” that would still linger weeks after the storm.

“That’s why the decision was made to move in that direction,” he said. “You need to put yourself in the hurricane category and condition where we have food, water and basic shelter because that’s still all we have basically in Bay County.”

He said he had informed the Department of State about halfway through mega-voting that he intended to accept some ballots submitted by email

Bay County Supervisor of Elections Mark Andersen confirmed to Florida Politics that his office accepted more than 140 vote-by-mail ballots by fax machine or email, despite an executive order explicitly prohibiting the practice.

Andersen said more than 140 vote-by-mail ballots were cast, 10 of them via email and the rest by fax. The Bay County canvassing board approved of each ballot before it was included in the county vote.

Sec of State Detzner said voting by fax or email is not an option under state law, and is not part of the executive order. Extensions for early voting was allowed. Miami Herald https://www.miamiherald.com/news/politics-government/election/article220230255.html

So they want the emails from the reddest part of the state counted, which is illegal, but don't want the 40 boxes of ballots in Broward County counted because someone deliberately didn't send them to SOE and ensured they weren't in play.

was denied a request to even email the vote by mail ballots out, that is to send out by email the ballots which would be returned by USPS mail.

What gives?? If this is true for Bay County...

I mean, what would the email even look like? You just type the names of the votes? There has to be an actual ballot and there is no ballot by email.

Andersen said he worked with 147 voters who returned ballots by email using similar protocols to those used for military and overseas ballots to allow voters to sign an oath and verify their identities.

The county supervisor claims to NBC-7 he told Secretary of State Ken Detzner his intentions before Election Day.

But in a release in an election plan for storm-struck areas released by Detzner on Oct. 18, state officials explicitly reminded elections officials that voting by fax or email is not covered by Scott’s order.

“In the hardest hit areas, communication via phone, fax and email remains challenging and would be an unreliable method for returning ballots,” reads a media release.

“Additionally, past attempts by other states to allow voters impacted by natural disasters to fax or email ballots have been rife with issues. The Department is actively reviewing ways to provide more absentee ballots to those voters in the counties severely impacted by Hurricane Michael.”

And Bay County Republican Party Chairman James Waterstradt says he was not aware before the election of email ballots being allowed. He served as an election observer during the recount of votes, which concluded last night, and said the issue of email ballots never came up there.

“I’ve only heard anything about email in reference to military ballots,” Waterstradt said.

Bay County Supervisor of Elections Mark Andersen said he had to take care of displaced voters and wanted their voices to still be heard.

He said he and his staff worked with 147 displaced voters making sure they signed an oath, verified identification, and secured the information.

According to Andersen, the ballots were returned by e-mail similar to policies for overseas voters.

We're all hypocrites in this, we want to win, and both sides only want to bend the rules when it helps their side. Let's not pretend otherwise.

Email and Faxes are not proper forms of voting. If they were, we would use them.

It is against Florida Law - this is why I think pRick Scott didn't want a recount. Some of these shenanigans were bound to come out sooner rather than later!

I think these votes probably shouldn't be counted. But anyone claiming that both sides don't take positions on these issues depending upon who they think the votes will go for has a greater capacity for self-delusion than I do.

The SOE lied and said he had to do this. He has to follow the law. he did not. How did they even verify that this was the correct person voting?? Emails are not reliable - neither are faxes!

Look.... it is 147 ballots........ so we're talking about stealing the election......

but at the same time that blue counties are under constant assault from voter suppression, when early voting is cut and polling station cut and voter ballots thrown out because the "signature doesn't match", every effort is made to stop Dems from voting and a red country gets to vote by FAX? and EMAIL????????????? And the president is tweeting about ballots "popping up out of nowhere?"

You can't just ignore the law now because you think it is unfair there is a burden on the hurricane victims. How many people in Broward county missed voting for some reason? They were sick, or had to work late or their car broke down. Where is there EQUAL PROTECTION? Why were they not allowed the option to FAX in their vote?

And who told Mark anderson HE has the right to change election laws as he sees fit? Let the votes stand, I'm okay with it (it isn't the voters fault this guy broke the law), but PROSECUTE ANDERSON.
