What To Know About New York Judge's Ruling Against The Trump Foundation

By Allegra Kirkland
November 26, 2018 11:53 am

A decision handed down by a New York judge over the Thanksgiving holiday weekend bolstered most of the key arguments in the state attorney general’s lawsuit against the Donald J. Trump Foundation.

Judge Saliann Scarpulla rejected the Trump Foundation’s motion to dismiss the suit in a Friday ruling. She affirmed that a sitting U.S. president can be sued for activities unrelated to his conduct in office. And she wrote that New York Attorney General Barbara Underwood’s allegations that President Trump used his personal charity to settle personal financial affairs and further his political career were “very serious.”

Scarpulla’s ruling was a green light allowing the case to proceed, exposing Trump to millions of dollars in potential penalties. Trump’s legal team must file a response within 45 days of her decision.

Here’s what you need to know about Scarpulla’s assessment of the case.

"...activities unrelated to his conduct in office".

This is the same underlying fact to all the crimes Trump has been accused of - Russian conspiracy, money laundering, etc... all occurred before he was in office.

Keep in mind, Nixon's crime was while he was President. I think at the end of the day, the court system will rule that Trump can be indicted due to the fact that the crimes he is charged with occurred before he was President. The "trump" card in all of this is there will likely be "duel" NY State charges that can be filed regardless. Trump has slowly backed himself into a corner where it is getting more and more difficult for him to leave office and not be charged. In fact, its certain at this point that he will be indicted on State charges. Book it. He wont see a day in jail because he is a President, but he will be charged.

But again, The Cretin does not qualify as a sentient parent...thus, his kids are going to have to do what they've done most of their life...talk to Mommy or do it on their own.

I surely hope he can be indicted when he gets, again hopefully, removed or resign from office.

The Trump family have all been using the fake foundation as their personal piggy bank for the last 10+ years. And Eric has been (supposedly) managing the foundation since Cheeto entered the White House. (yeah, right!)

They should get adjoining cells in the Ossining state prison.
