As another response mentioned, this applies to the intelligence community, but it was TRUMP'S intelligence community and this article mentions Kushner's friendship with the Crown Prince as a reason why the warning may have not been issued. In most any other situation, the person in charge is responsible for the failures of his agents to follow the law. This would be especially true where the misfeasance was ordered or encouraged by the person in charge.
