Romney and Bain profited from massive Medicare Fraud

From the delightful gift that is John McCain’s opposition research on Mitt (courtesy of namelessgenxer) comes the sordid tale of Mitt’s tenure on the board of Damon Clinical Laboratories, which plead guilty to charges of defrauding Medicare and agreed to pay what was at the time the largest health care criminal fraud fine in history – $35,300,000. They also agreed to larger civil fines which totaled $83,700,000.

I originally published this back in January, but given the recent focus on Bain it’s worth a revisit. Also, I’m republishing this to The Bain Files to add to that archive of Mitty evildoings.

The time line goes as follows.
1988: Damon begins a systemic practice of fraud. The government estimates later that the total cost to taxpayers of this fraud is around $40,000,000
1990: Bain Capital (CEO Mitt Romney) buys a minority stake in Damon. Mitt takes a seat on the board of directors
1990 to 1993: Mitt serves on the board of directors, earning ~$10,000 per year for doing so. He is on the company’s “Strategic Planning” committee
1992: Romney said that [Damon’s then-CEO Robert] Rosen told the board in about 1992 ‘that all current practices at the company were now in conformity with government regulations and that in the past there may have been practices which would not be deemed appropriate.
1993: Damon is taken over by Corning, with Mitt Romney voting in favor of the acquisition
1993: Corning immediately closes Damon’s Massachusetts plant and lays off 115 workers
1993: Corning uncovers the fraud and alerts authorities. The SEC filings made by Damon prior to the acquisition make no mention of any potential earnings write-downs or legal problems
1993: Mitt Romney’s share of Bain’s profit from the Damon investment: $473,000
1993: Bain’s profit from its investment in Damon: $7,400,000, which represented a tripling of the initial investment
1994: Running for Senator, Mitt Romney says:
I’m proud of the small part I played in the growth of Damon,’ Romney said yesterday. ‘It’s something that Ted Kennedy doesn’t have a clue about – creating real jobs in the private sector.
2002: While running for governor, Romney claims that he helped uncover the fraud by starting an investigation. This version of events is disputed by Corning and by the Federal Prosecutors. Mitt also says he never alerted the authorities, which no one disputes.

So - Bain invests in a company. Mitt gets personally involved with managing said company. Company profits are significantly based upon Medicare Fraud. Bain & Romney never uncover the fraud in 4 years, Corning uncovers it immediately upon buying Damon. Despite the fraud, Bain triples its investment, and Romney's share of that profit is a cool half a million.

Of course, Mitt-sie's a Republican, the corporate news media is lazy, arrogant, and gutless, and probably feels that Mitt deserves a free pass.

Even if he doesn't run for POTUS, as it's beneath him most likely in his POV, he's going to be on hand and not as an ordinary delegate, no doubt. He's going to be overseeing his puppets, Paul Ryan and Mittens.

He's run for POTUS before on the Libertarian Party ticket, which his family has been a part of and failed to get a direct win. The Libertarian Party is trying to get the GOP off the ballot in Washington state for some obscure reason, denying the GOP, or rather, the Tea Party voters.

But the Tea Party is their creation, too. There is nowhere for the GOP voter to turn that is not part of the Koch family echo box. They've founded and bankrolled the John Birch Society, who are the Patriot, Soveriegn Citizen and Infowars idols. Anti-establishment in name only.

Ron Paul also ran for POTUS on the Libertarian ticket, and his followers still think these people who are trying to destroy this country didn't pull that puppet's strings, for some reason. They have been deluded by conspiracy media as alternative to those awful 'statist, progressive, liberal, gun grabbing, baby killing Demon-Rats.'

Now Koch has all his underlings in one place, and with the money he's donated to the GOP to defeat Obama, he may call in his markers in the public eye at last. ALEC is in trouble, but why not show the real face of these front organizations, like the Cato Institute, Freedomworks and Americans for Prosperty?

The Koch brothers have been involved in the installation of puppets in several states, such as Scott Walker, Rick Scott and Paul Ryan, just to name a few. Koch corporations are opening offices next door to legislatures and lobbying to stop public infrastructure so that they can take it over as they are doing with bridges, roads and water resources.

Multigenerational political influence by a very narrow special interest group is rare, but we're seeing it played out right now in front of us. A billionaire family - the Kochs - have gone from influencing my father's generation, to my generation, to my kids' generation - and very few Americans realize it. Daddy Koch - Fred - made his first millions palling around with Joe Stalin in the Soviet Union in the 1920s and 1930s. As the fascists rose to power in Europe in the 1930s, he was an enthusiastic supporter of Italian dictator Benito Mussolini, who invented the word "fascist," meaning essentially the takeover of democratic governments by big business interests. Mussolini went so far as to dissolve the Italian parliament, and replace elected politicians with representatives of each district's largest corporations. Fred Koch and Mussolini both particularly hated the trade unionists and their sometimes allies, the communists. So after Mussolini, along with his ally Hitler, lost World War II against America, Fred Koch brought the anti-communist pro-business-running-goverment - what some would call "facist" - torch to America big time, helping start the John Birch Society.

Two of their biggest efforts are pretty well known. After the Supreme Court ruled, in 1954, in the Brown versus Board of Education case, that segregation in schools was unconstitutional, the John Birch Society put up billboards all across America calling for the impeachment of the Chief Justice of the Court, Earl Warren. Daddy Fred Koch was very concerned about the integration of our schools - in fact, he wrote, "The colored man looms large in the Communist plan to take over America." With JFK's election, Fred Koch's John Birch Society went off again - this time against JFK. Using rhetoric not that different from the "secret Muslim" plots the Tea Party promotes about Obama, in a 1963 speech Fred said that " infiltrate the highest offices of government in the U.S. until the President is a Communist, unknown to the rest of us.”

When JFK was scheduled to come to Dallas that year, the JBS distributed flyers saying, "Wanted, for Treason" all around the town two days before his arrival. On the day JFK was assassinated, large ads ran in the Dallas newspapers attacking Kennedy as being soft on Castro, among other things. That was my dad's generation. Daddy Koch died, and his sons Charles and David took over the family business of promoting the business and billionaire takeover of our American government.

They're doing it with a two-pronged attack. For people over forty, they're funding the Tea Party through a variety of groups, most notably Americans for Prosperity and Freedomworks. And for people under forty, they're funding Libertarian think tanks, like the Charles Koch Foundation (which was renamed as the Cato Institute), and the Reason Foundation, where David Koch is a trustee, which happily embraces a new generation of young people with the idea that "freedom" means the "freedom" to buy politicians and the "freedom" to pollute. For the young people, of course, the Libertarians throw in the "freedom" to smoke dope and hire a hooker, but those are just bones being cynically tossed to young potheads and young protoge's of Dick Morris.

But the Koch's have been inside the Libertarian movement from its beginning - 32 years ago this year, David Koch was the Libertarian Party's official candidate for Vice President of the United States. It's really pretty incredible, but it's all true. The main agenda of the Koch's John Birch Society was to enhance the power and control of our government by big business and billionaires, while fighting organized labor and people like me who were protesting the Vietnam War. The main agenda of the Koch's Tea Party is to get millionaires elected to Congress and have them cut taxes and regulations for Koch Industries and other polluting corporations, while fighting organized labor and people like me who were protesting the Iraq War.

And the main agenda of the Koch's Libertarians - again, funded and trained by the Koch Brothers - is to keep intact the power of big money over our government, cut taxes and regulations on billionaires and polluting industries, while fighting organized labor and people like me who are protesting the corporate takeover of the United States of America. Three generations of Americans, all duped by the same billionaire family. Three generations buying into the idea that "what's best for industry and billionaires is best for America" - and that government is our "enemy" rather than something that our nation's founders fought and died to create for all of "We The People" And, increasingly, it's not just the Koch family. The Walton family - whose combined wealth is greater than 40 percent of all Americans - funded a covert campaign to rename the estate tax as the "death tax" and lobbied so hard they got the estate tax eliminated entirely in 2010.

Senator Bernie Sanders pointed out yesterday that - so far - we know of 26 billionaires - worth over $146 billion - who have already "invested" or committed to invest over $561 million dollars in this election cycle - most of it to defeat Democrats who want to raise their taxes. The good news is that young people are waking up and realizing that the Libertarian hustle the billionaires are feeding them is just that - a hustle. Just like Tea Partiers are waking up to their having been had by billionaires who want to privatize their Social Security. Hopefully, soon, America will regain its sanity and we'll go back to viewing cranky billionaires the way my Dad's generation did - as Republican President Dwight D. Eisenhower did - when Eisenhower referred to their ilk as "small in number and stupid" They're not stupid any more, and if we really value American traditions, we really must push back on this kind of power and influence in American politics. A lot of Paulistas, Libertarians and Teabaggers do not want to listen. But there are other sources to back up the claims. Scary to think the thread leads back to some of the worst days in world history. But we've been living this nightmare a long time.

Debating in Tampa, Florida in late-January, Mitt Romney denied that Bain did “any work with the government like Medicaid and Medicare”. Now we learn that Bain, under Romney’s “supervision”, purchased and ran the Damon Corporation, who pled guilty to Federal conspiracy charges as a result of tens of millions of dollars in systemic Medicare fraud committed under Romney’s and Bain’s control. Carl Cameron of Faux news deliberately suppressed the story, fearing it might affect the result.

That's not what I read elsewhere. Just for grins I traced a link to Free Republic and whoever-it-was who did the research for the extensive article I found over there (which I cited with glee as a rebuttal to another right-winger) stated that Corning, which acquired Damon Clinical back in 1993, was the outfit that called in the Feds, NOT Bain Capital.

I realize we all have issues with FR and its owner. But this once it looks like there was a pearl in the--(ahem)--heap.

Of course the post at FR might since have been erased so as not to damage R-money's chance in the fall elections.

Most of the noobs and the blind followers on the right won't care. On the other hand, there is a certain percentile that votes Republican that occasionally uses their brains. There may not be all that many of them, they may not a majority of the GOP, but they're there. Cooling their enthusiasm for R-money and Rand/Ryan in the face of Medicare fraud might inspire some of them to sit out this election.

So, if the above is correct, the board, including Romney knew that there had been "inappropriate" practices in the past, but these practices weren't reported until Corning discovered and reported them.

That's one thing Obamacare goes after. If repealed medicare goes broke in less than 4 years. So Ryan's 10 year plan does not work. His mom is quiet wealthy, house down in Florida. She does not depend on medicare.

The federal court records will tell you the story of McKeown and the Marshall case, McKeown's 3 bankruptcies, his four attempts to remove his eviction case to federal court in 2013, his attempts to intervene in Pamela Carvel's bankruptcy case in Florida (and the contempt order and writ of bodily attachment the Court issued against McKeown), his attempt to sue the City of Chicago for patent infringment, etc., etc., etc.

WITH PREJUDICE AND WITHOUT DISCHARGE

ORDERED, that the Motion is granted and the Debtor’s chapter 7 case is hereby
dismissed with prejudice and without a discharge, and the Clerk of the Court is directed to close
this case; and it is further
ORDERED, that the Debtor is barred from filing another petition for relief under any
chapter of the Bankruptcy Code in any jurisdiction for five (5) years from the date of entry of this
Order; and it is further
ORDERED, that should the Debtor file a bankruptcy petition within five (5) years in
violation of this Order, such bankruptcy case will be transferred and/or assigned to this Court, and the
Debtor will not be afforded any of the protections provided by the automatic stay under section 362
of the Bankruptcy Code.

COMPLYWITH THIS COURT'S ORDER TO SHOWCAUSE DIRECTING MR.

DIRECTING CLERK TO ISSUE WRIT OF BODILY ATTACHMENT
THIS CAUSE came before the Court for hearing on November 1, 2011 at 10:30 a.m. (the
“Hearing”) upon the Trustee's Motion for an Order to Show Cause as to Why Kevin McKeown
Should Not Be Held In Contempt of Court For Unauthorized Practice of Law and Intentional
Interference With Trustee's Administration of the Bankruptcy Estate (the "Motion&quot (D.E. 224)
and this Court's Order to Show Cause (the "Show Cause Order&quot (D.E. 243) and Order
Continuing Show Cause Hearing (D.E. 250). In consideration of Kevin McKeown's ("Mr.
McKeown&quot , failure to appear or be represented at the Hearing, the failure to otherwise comply
with the terms of the Show Cause Order, the presentation of counsel, and the Court being
ORDERED in the Southern District of Florida on November 2, 2011.
otherwise fully advised in the premises and based on the entire record of the Hearing, including,
without limitation, for the reasons set forth on the record at the Hearing, the Court hereby
ORDERS AND ADJUDGES that
1. Mr. McKeown is in civil contempt of the Show Cause Order for failing to appear
at the Hearing as ordered in the Show Cause Order.
2. The Clerk of Court is directed forthwith to enter a Writ of Bodily Attachment
commanding the United States Marshal Service to take Kevin McKeown into custody and to
deliver Mr. McKeown to this Court for further proceedings.
3. The Court reserves jurisdiction to enforce the terms of this Order.
