(94,360 posts)The 25th Amendment allows the VP and Cabinet to the President's powers to be transferred to the VP IF "the President is unable to discharge the powers and duties of his office". It says nothing about replacing him on the basis of a tainted election. It ALSO allows the President to challenge the decision, in which case the issue goes to Congress, requiring a 2/3 vote to uphold the decision.

(33,258 posts)It cannot be unconstitutional because it's provided for by the Constitution. The reason for the checks on it is to help prevent its misuse. His opinion about it being used to "circumvent an election" does not make it an unconstitutional act, it just makes it more likely to fail to pass the checks built in, if true.

(52,123 posts)as you said, veep, majority of cabinet, 2/3 of house, 2/3 of senate.
that's a whole lot of people and institutions across parties, notably including the president's inner circle.
for them to agree the president's got to go, it pretty much has to be because the president's in a coma or otherwise so obviously incapacitated that even his closest supporters agree he's got to go.
if the people needed to make it happen agree to make it happen, it's constitutional; really, the stated reason doesn't much matter.
in practice, it's extremely unlikely to ever happen for the "wrong" reasons.
for our present-day circumstance, it's ridiculous to think it has any shot of happening to remove donnie.
there's just no way you'd get the necessary people to agree.
