Given that there is no definition of what constitutes an emergency in the National Emergencies Act and given further that it could just as easily be said of many if not most of the currently active national emergency declarations that the president didn't "have to" make those declarations, I think a court could basically ignore what he said. Hopefully they won't, but I think they could. There is an assumption being made that the term emergency means some action is urgently needed. That certainly is what most people would think when they hear the word emergency. But again, looking at 32 active emergencies, more than half of which were declared more than a decade ago... urgency doesn't appear to have been a significant consideration in many of them.

For the same reason, while I think its great that Trump is such a poor judge of optics that he doesn't recognize the folly in declaring a national emergency and then going off to play golf, the reality is that the existence of a declared national emergency has rarely if ever altered a president's schedule.

Yah, whether his definition of “emergency” matches anyone else’s may not be relevant to the discretion and deference afforded presidential determinations.

Only issue is will RW Russian/Reupg SCOTUS give a shit? Can 't trust the Russian Repug Senate to do the right thing, not at all. So it's either Roberts stands with the constitution or it's not our governing document anymore. What matters to rw'ers is whatever PUtin tells drumpf he has to do and whatever Hair Furor can steal for himself. The USA as we knew it will be in the throes of destruction.

Roberts please save us because the other 4 RW'ers won't.

but, he's smarter than Trump and at least Bush realized he wasn't the smartest guy in the room. (Still a horrible president, but Trump sets new lows every day)
