Yes, the Democrats used the tactic of pro forma sessions as a way to keep bush from making recess appointments in 2007 and 2008. And when President Obama decided today to challenge the use of that tactic by the repubs against him, he did so with a particularly sharp implement: the words of two of the bush administration lawyers, who had written an op-ed in 2010 claiming that the pro forma session gambit wasn't valid. In short, the message from the WH to the repubs is: hey suckers, just cause you fell for it when we did it doesn't mean we're bound by it.

Compared to past presidents. Until now, he has made 28 recess appointments. By contrast, former President George W. Bush made more than 170 during his presidency and former President Bill Clinton made almost 140.

There are a few judgeships and agency positions that could have been filled, too. Okay, more than a few. But there's one appointment. Absolutely no question about that. Yup. Got one position filled. All done now.
