At Least 13 States Will Join Lawsuit Challenging Emergency

California and at least a dozen other states will be joining a lawsuit to challenge President Donald Trump’s national emergency declaration, California Attorney General Xavier Becerra said Monday. “The president admitted that there’s not a basis for the declaration, he admitted there’s no crisis at the border, he’s now trying to rob funds that were allocated by Congress legally to the various states and people of our states,” Becerra told MSNBC. “The separation of powers is being violated, we’re going to go out there and make sure that Donald Trump cannot steal money from the states and people who need them, since we paid the taxpayer dollars to Washington, D.C. to get those services.”

Speaking on CNN, Becerra said the lawsuit is imminent. “We should be filing sometime today,” Becerra said. “We’re going to try to halt the President from violating the Constitution, the separation of powers, from stealing money from Americans and states that has been allocated by Congress, lawfully” ...

ALBUQUERQUE, N.M.- Gov. Michelle Lujan Grisham announced that New Mexico will sue the Trump administration for declaring a national emergency to pay for a wall along the U.S.-Mexico border.

“The president’s absurd and dangerous declaration, a bald-faced end run around Congress and the basic tenets of our nation’s system of governance, will not stand,” Gov. Lujan Grisham said.

The governor said the president’s declaration “diverts funds crucial to the protection of New Mexicans away from their proper channels and puts New Mexico’s economy and people at risk.”

Attorney General Hector Balderas said he is appalled that Pres. Trump “would bypass the rule of law” ...

... New Jersey is joining a lawsuit expected to be filed Monday in California which argues Trump’s emergency declaration is an illegal use of the federal National Emergencies Act, a spokesman for state Attorney General Gurbir Grewal confirmed.

“As the chief law enforcement officer for New Jersey, I have a duty to stand up for New Jersey’s residents – including our immigrant community – and so I’m joining states across the country in challenging this emergency declaration in court,” Grewal said Monday.

After Congress approved far less money for border security than he had sought, Trump last week announced he would use the emergency declaration to stem illegal immigration, which he called “an invasion of our country.” The move, if it survives legal challenges, would allow the president to access the billions of dollars the president says is necessary to fortify the nation’s southern border.

Grewal, who was appointed by Democratic Gov. Phil Murphy last year, is a native New Jerseyan born to Indian immigrant parents who has been vocal in his opposition to Trump’s immigration policies. He noted that Trump himself acknowledged during a press conference he “could do the wall over a longer period of time," but would "rather do it much faster” ...
