House Dems, Senate GOP, Impeachment and Indictment -- My Take

Cohen: Don't believe my allegations. I brought incontrovertible evidence for you.

GOP: You'll always be a liar.

Cohen: My lies were to protect Trump, which you are doing right now.

Me: The House now has evidence enough to impeach Trump. The Senate must decide either to indict or to obstruct justice by refusing to indict.

Holder: A sitting president can be indicted.

Mueller: No one is above The Law.

3. They can be campaigned against as obstructing justice by their opponents. Their failure to act, on

evidence that proves presidential crimes beyond a reasonable doubt, can indict them as upholding and defending the Constitution.

So those who refuse to indict should lose and themselves be indicted.

4. The Senate has no ability to indict.

If the House impeaches, the trial will be in the Senate which can choose to convict (on a 2/3rds majority) thereby removing Trump from office, or acquit.

Indicting for a criminal offense is the purview of the Justice Department.
