Aren't the RETHUGS making a BIG mistake,(by NOT over riding tRUMPS veto)? When a Democrat WINS in 2020? Will this SC. decision set precedence? I'm not sure how this works out.

1. It seems to me that

if the Repugs maintain IQ45's veto then they should sit down and shut up when the next Democratic president declares a national emergency regarding global warming and gun control.

I mean, why would they change their thinking on that? They have always been against any Democratic budget that has any kind of deficit - so of course they'd NEVER create one themselves, would they?

Seems very clear to me............

5. I don't think that would work

The declaration of a national emergency boosts executive authority in distinct ways... not just anything the president wants to do. It’s largely related to an unwise delegation of legislative authority to the executive branch

However, Congress doesn’t have the authority to (for instance) ban all handguns... so the future Democratic President couldn’t claim that they had delegated that authority to the president in emergencies.

On climate change, prior Democratic administrations have already used emergencies for executive action, but there isn’t enough wiggle room there to have much of an impact. Even if Trump succeeds in redirecting a few billions to a wall... that’s a drop in the bucket compared to what is needed.

3. They will try their damndest to make the ruling as narrow as possible

so it can't be used as precedent much the same as they did with Bush v. Gore. Either that or they'll be sure to leave an opening they can use later to strike down a Dem president's emergency declaration.

6. Not sure what they legal argument they are using,

but I'd probably argue that the law giving away Congress' Article I constitutional power was in itself unconstitutional in the first place.

the first thing a Democratic POTUS should do is declare a gun emergency. Do guns kill more Americans or do migrant mothers and their babies?
