Florida man plans live event

What could possibly go wrong?

Vero Beach property owner Joyce Khatibi told Melbourne, Florida fisherman Jose Ortiz he couldn’t fish from along State Road AIA because she owns the water....

...The flap has now led to a planned “event” — Fish Joyce’s Dock — in which Ortiz has invited other fishermen to come join him out on the water at this location at 9 a.m. Saturday.

Ortiz, via the Fish Joyce’s Dock page, promises to stream video on Facebook Live and initially expected about 400 people to take up his call.

But the Facebook page now has more than 7,000 followers and a large number of fisherman, put off by Khatibi’s claim that she owns the water, vow to take part. On Thursday afternoon, Ortiz said he now expects about 700 to turn out.

A post, with a photo of the proposed meeting area, urges boaters to anchor within a specific square in the water, well away from docks and to avoid sending waves and wakes in the direction of the properties....

Whatever insanity is happening in your state, Florida has done it with an alligator and possibly some amphetamines.

The Florida Man is a bit of an enigma. He is the frayed fabric of a worn tobacco ring in his left back pocket. He lives in the breeze that goes through your hair while doing donuts on an ATV. He is the slight echo in the air when someone says, "Hey, watch'is!" He is Florida, and Florida is him. Do not confuse him with your average male resident of Resident: Florida Man is a brand.

Every day there is a story that involves one of them shooting something or screaming incomprehensible babble in a Natural Light addled rage before getting arrested. And while we all may have a little bit of shame for our hometown stories, we can always rest assured that at least we aren't from Florida, unless you are from Florida, in which case, we're keeping you in our thoughts.

To honor the Florida Man, we have compiled a list of his most absurd headlines from this year. Granted, all of these should be treated as allegations. While we are treated to the idea that a Florida Man, say, exposed himself in the Walmart pillow aisle, we will not be treating it as if it's fact. That is between the Good State of Florida and the Florida Man to decide. But allegations do not keep us from laughing to ourselves. So put in a lipper of Skoal and settle into the nearest papasan chair because we have some headlines to discuss.

This is the best of the Florida Man, 2019....

In many waterfront communities, homeowners are claiming rights beyond the waterline (ripparian rights). They are haveing the local law ticket fisherman for fishing from boats along the waterway.

You see, fish like structure, like piers and docks, and fisherman like fish.

But the homeowners claim they own the water. Which is typically nonsense since riparian rights end at the high water line, except in FL.

In FL, if a canal or lake is man made, individuals can own it. So fisherman can be ticketed.

It is an extension of the disputes between landowners and those seeking shore access for swimming, sunbathing, or fishing.

It's a rich against every one else thing.

It's not funny. It's a real issue. And I'm from MA, and don't spend ANY time in FL (too many new yorkers and maga types).

Since that doesn't appear to be a man made body of water, her property line ends at the high tide line. She can't own the water, even directly under that pier.

Sorry rich white privileged florida lady. You are wrong and florida man has a right to call you florida woman.

Riparrian rights dictate her property line ends at the high tide line.

The fisherman is correct. He has every right to fish there as long as he doesn't tie his boat to the dock. He can literally float right under that dock. It's a navigable waterway.

She is a rich entitled snowflake. It's a good thing she didn't have a gun.

But fisherman do care because if the water in FL gets too hot, a lot of the fish they go after will migrate north.

We are already seeing florida fish appear in the northern canyons. All kinds of jacks. We never used to see those in any numbers, but now we do.

Just as lobsters are fleeing (dying off in) the region south of the cape to RI, fish will flee FL if the water gets too warm.

So yeah, fisherman care.

I'm seeing more and more stories about fishing fleets having to move their operations, and where ops are primarily in territorial waters, many local fishing operations will be screwed.

I suppose fishermen will be studying what species will be migrating to their territory......

On both sides. The intercoastal is a navigable waterway and doesn't count as a man made structure like a canal or lake would,

Besides, the roadway is an easment that allows anyone to travel. So really anything on the other side of the road is probably public access anyway.

Without him, "Pennsylvania Man" would be the 'official' national laughingstock. And we've got enough problems here w/out adding that.

So please, Florida Man, carry on!

(And best of luck to the fisherman. This homeowner sounds like a real PITA.)

...Ortiz said he had fished at the spot for years but was interrupted on a recent trip by Khatibi, who claimed that he had been trespassing in a section of the water that she owned.

An Indian River County Sheriff's Office report obtained by WPEC (CBS12) confirmed that Ortiz was initially asked to leave the area. But after a follow up, officers found Khatibi did not own the water she claimed to. Ortiz said he would be filing an official police complaint.

“We… reviewed the actual parcel that Joyce owned. Her property line does not extend into the water like her neighbors. Her property only includes about 5 feet of shoreline. Jose had never approached the beach area that Joyce owns,” the local police incident report stated.

Khatibi told WPEC she did not directly spray water at the fisherman, just in front of him “so he would stay back.” She claimed he had “trespassed through several private properties.”

VERO BEACH – Hundreds of fishermen are expected to participate in the Fish Joyce’s Dock event on Saturday at 9:00 a.m. in Vero Beach. Sebastian Daily will be streaming the event LIVE Saturday from its Facebook Page.

It’s probably fair to say that property owner Joyce Khatibi didn’t know what she was getting herself into after telling a fisherman that she owns the water in front of her home on State Road A1A, south of the Sebastian Inlet in Vero Beach.

Jose Ortiz, of Melbourne, who uses the alias Tony Toca on Facebook, says he regularly fishes the docks along the waterfront property. But when he did so last Saturday, Khatibi started yelling at him and aimed a water hose in his direction. Khatibi told Ortiz she “owns the water” and that he’s not welcome near her dock anymore. Ortiz says he’s been fishing the docks for over 20 years without incident.

Ortiz recorded the exchange between himself and Khatibi on the dock. “I own from this telephone pole all the way down,” Khatibi yells from the dock. “All of this water is yours?” Ortiz asks. “Yes,” Khatibi responds.

“Impossible. Impossible. Impossible. You don’t own the water, sweetheart,” Ortiz tells her. “Yeah, we do,” she says.

The fisherman then says, “I’m going to make you famous.” Khatibi then picks up a garden hose on at the dock and begins spraying water in the direction of Ortiz as they continue to argue.

The exchange gets testy. Ortiz suggests she’s “rich” and “miserable.” Khatibi then tells Ortiz not to be jealous.
