'Our paychecks bounced': US workers in limbo as coalmines suddenly close

Blackjewel files for chapter 11 in a move critics say is increasingly used to avoid paying workers what they are owed

On 1 July, Missy Cole was notified by her bank that her husband’s most recent paycheck had bounced, leaving their account more than $1,000 in the red. Her husband had worked as a coalminer for nearly three years at one of the eastern Kentucky mines operated by Revelation Energy affiliate Blackjewel mining.

But both companies had filed for chapter 11 bankruptcy, a financial move that has implications far beyond just laying off staff as the ex-workers now wait for bankruptcy proceedings to play out. Critics say the move is a ploy increasingly used in the struggling industry to avoid paying workers what they are owed.

“A layoff is always expected with miners. It’s always in the back of your mind and it’s no surprise when it happens in the coal industry. But this is much more than a layoff,” Cole told the Guardian.

“We have absolutely no access to our bank accounts. Those accounts are still negative, and falling deeper into the negative daily. We cannot even touch his 401(k) to withdraw money to survive on without the signature of the Blackjewel mining CEO or his personnel.”

Since a lot of these miners voted for the trumpster.........................they now have a new worry too putting food on the table, guess what...............................they will have a whole new "means test".....................congratulations, now what do you think of your "guy"..........................and the cronies at the mine.....................pocketing your 401K savings........................because of the two books being used hiding the robbery, if you have money in savings, even if you can't get access to the savings or the bounced checks, you can't collect unemployment insurance, why might you ask, its an asset.........................

So, come next November 3, 2020 just think about all of those great jobs he said he was going to save for you, and the CEO of the mine ripping you off..........................and giving that money to trump for his re-election..........don't you just love being sold a bill of goods on making maga again, don't you................................

So the next time your in line for SNAP just thank your trumpster and how you support a narcissistic treasonous racist asshole that doesn't give one iota about you, but himself and his cronies...........................so put on that hard hat and or that red hat and that red white and blue shirt .......and then have your signs at his rallies and just smile, so that he can tell himself, while your cheering and wondering about your next plate of food chanting "send them back" (that maybe he and his trolls are talking about you) .............and while you stand in line for SNAP...........................knowing that he has now made another "means test" of outright bullshit of just lacking any empathy or vision except of his, I got mine, attitude, because after all who needs food, and you paid for that program ( Snap) to protect you in the event you are now in...............................

Blackjewel's business practices have left small businesses eating the debt and they had to be harassed to pay their bills.

The only difference is that now they have to pay their own way, and this time they get no closer than being rebuffed at the gates by security guards who are trained and paid to deny them entrance and have them arrested if they don‘t leave immediately. Maybe they can get some good film of their new reception to show the folks back home how Trump really felt about them all along.

The administration, of which is Mitch, is pursuing cutting 3.1 million off of food stamps as per an early DU story this AM. Is this starving the beast after they've been fucked so they die and can't sue for lost wages and 401k theft. MAGA. Trump Digs coal..........tycoons.

When he was hired (in 2011 after military retirement) coal was booming. They had so many coal trains. Then it was dramatically decreased. So many of the railroaders that made so much money with coal trains listened to Trump in 2016. Union told them to vote for Hillary. Oh no..Trumpis bringing back coal so they voted for him. All they talked about is how bad Hillary and Obama were. Now they have Trump. Coal trains did not increase. Then he reduced what they could claim on income taxes with his “tax reform”. This caused a huge decrease in returns. Then they were sitting there looking stupid when they found out how the tax reform affected them.

Pure lowest common denominator, tribal trash talk that pats you on the back for tearing others down rather than building yourself up. They have nothing but hatred and anger now where there should have been a carefully nurtured soul.

I noticed years ago when Rush and Hannity slaves started scoffing at anything good, kind, compassionate and ethical. You might get away with that when humans are involved, but Mother Earth doesn’t put up with that shit for very long. Time to crawl out of the coal mines and into the 21st century.

But getting a job in that industry isn’t a way to protect your bank account. I don’t care who these people voted for. We need strong numbers and power so we can help them out. There are better ways.

401k plans are supposed to have independent administrators. There should be no way that a bankrupt company can take what someone holds in a 401k account. Company sponsored pension plans are potentially vulnerable, for sure, but even these have Federal safeguards through the Pension Benefit Guaranty Corp. (PBGC).

through the airline industry, 25 years as a mechanic ---flight line------since the defined pensions plans are being "phased" out with these so called 401K's hoping that the wall street crowd will be nice to the investor, they are not and they never will be.

I and many others were or still with an airlines, I happened to be a former employee of an airline that was employee owned, when 9/11 happened, ( we gave up a lot to get rid of Steve Wolf) we the employees, went to wall street to help the carrier (United) make it thru the time frame, they said no, they did not want employee owned firms such as ours on the books, there was massive layoffs....................so the carrier filed for bankruptcy, along with many others after the fact, some sooner, some later, in the background of this is one 1974 law called the Erisa Law and Erisa says it all and it has been used to determine if you get or do not get benefits.....................:
