A week after Navy SEAL Chief Eddie Gallagher was found not guilty of murder at a military court-martial that garnered international media attention, members of the U.S. government team that prosecuted him were awarded medals for their "superb results" and "expert litigation," according to legal filings obtained by Task & Purpose.
The Navy's Region Legal Service Office in San Diego hosted an award ceremony on July 10 in one of its courtrooms for four attorneys and four legal support staffers involved in the Gallagher case, according to a motion filed in a companion case on July 19 by military attorneys representing Navy SEAL Lt. Jacob Portier, Gallagher's former platoon commander.
The prosecution team all received Navy Achievement Medals, which "commended the trial teams' 'exceptional witness preparation,' 'expert litigation on constitutional issues,' and 'superb results,'" the motion said, apparently quoting from the award citations.
The motion also claimed that the RLSO Chief of Staff said words to the effect of "no matter the result, we were right to prosecute [Gallagher]," and "justice was done."

(3,299 posts)In the weird world of "military justice" I've heard of prosecutors being rewarded for losing high profile cases before. And lately, even presidents seem to have no compunction about expressing their opinion about guilt before trial in improper attempts to influence the disposition of cases. This is a new twist. The prosecutors obtain the result apparently desired by the CinC and yet they still get the back hand.
The prosecutors really have no say in whether a case goes to trial or not, it's the chain of command.

Id be happy if there was a massive negative reaction but I dont expect one.

(4,604 posts)Although I suppose he could make a Commander in Chief case on this one. While I'm decidedly not a fan of nor recommend coups, I keep hoping he will continue to offend powerful insiders in the FBI, CIA and all the Armed Forces. The more enemies the better.

WASHINGTON Navy Secretary Richard Spencer will rescind the military awards given to the prosecutors in the court-martial of Navy SEAL Chief Petty Officer Eddie Gallagher after President Donald Trump directed him to do so, a Navy official said Wednesday.
The [Navy] secretary is going to pull the awards and he does have the authority to do that, said a Navy official who spoke on the condition of anonymity to discuss the matter.
The official said he did not know when Spencer would rescind the awards, which were given to all the prosecutors who worked on the Gallagher court-martial.
The announcement of the decision follows a tweet by Trump on Wednesday afternoon directing Navy leadership to take away the awards. The president tweeted the prosecutors were ridiculously given the Navy Achievement Medal.
