I don't think it's quite the condemnation, nor should be, of Holmes' phrase as some might think. "Fire in a crowded theater" is still used, and will probably continue to be, because it it expresses in layman's terms a succinct and common sense illustration of the limits to the principles of free speech. It retains relevance today because there are still obvious (and necessary?) limits on speech.

It denotes something should be taken away so everyone has it equally as terrible. It says the white man should have been shot dead for his idiotic social experiment.

From another perspective, race (or class) privilege is not uniquely American and has been around since the dawn of civilization -- the haves and the have nots.

Let's level up equal rights and not level them down. I like to point out that Venezuela has largely solved economic inequality. Over 90% of the population has moved into poverty in the last decade. There was a bit of folk wisdom about Russian peasants--whether authentically pre-Revolutionarily true or not, I don't know. If a peasant saw a neighbor with a cow, he could either work to get his own cow, steal his neighbor's, or kill his neighbor's. In some countries, the peasant would work for his own. In others, he'd steal. But in Russia, the peasant would kill his neighbor's and then celebrate that he'd improved his lot because he was now equal with his neighbor.
