A Quiet Army in Himself’: Trump Judges are Giving Clarence Thomas the Judicial ‘Troops’ to Remake Constitutional Law

As Americans call on lawmakers to take action in response to the most recent spate of mass killings, it isn’t just the National Rifle Association and its bought-and-paid-for legislators standing in the way. It’s also a federal judiciary that is being packed at a record pace with judges who share Supreme Court Justice Clarence Thomas’s once-lonely radicalism on the Second Amendment—and on decades of constitutional law that undergird much of what the federal government now does.

“Clarence Thomas and the Lost Constitution,” a fawning book by conservative author Myron Magnet, celebrates that “a significant number of key administration officials and federal judges” are former Thomas clerks, “including 20 percent of the appellate judges President Trump has appointed.” (And that was written before Neomi Rao—described by Magnet as “the Trump administration’s lion-hearted scourge of administrative-state regulations”—took her seat on the Court of Appeals for the District of Columbia Circuit.)

As bad as Trump's Presidency has been, the damage will continue for many years as these far right Judges rewrite the law and make precedent.

1. Call for impeaching the judges. Undo Trump

Trump is illegitimate and therefore so are his judges.

If we don’t impeach them, we’re just incentivizing Republicans to keep stealing elections.

Impeach. Or pack the courts with Dem judges: 2 judges for every Trump judge. (That can be done with majorities in both houses and the president.)

An illegitimate president is justification enough. Impeachment isn’t within the criminal or ethical code. The constitution says that the Congress gets to define the reasons for impeachment.

But if impeachment is too hard politically (Constitution hard-codes a 2/3 majority vote), let’s just add 2 Dem judges for every Trump judge.

The key is to undo Trump.

Don’t just fill vacancies.

Create two NEW vacancies — two new seats — for each Trump judge. To nullify their effect.

Was there the political will for the Civil Rights Act in the 1950s? Did that stop MLK and the civil rights movement?
They CREATED the political will.

So must we - by talking about this. Undo Trump. Nulllify his judges, one way or the other.
