On Aug. 21, Weimar was asked to clean a toilet at the Lowell facility as part of a work detail but a pre-existing hip condition that caused her pain rendered her unable to do so, according to the lawsuit.
She allegedly requested and was denied a reasonable accommodation for her physical disability in connection with her prison work assignment and a confrontation ensued.
Under FDC policy and procedure, prison officials should have called medical personnel to intervene once Plaintiff Cheryl Weimar declared an inmate medical emergency, the lawsuit says. The more Plaintiff Cheryl Weimar complained of her physical condition, the more angry, aggressive, and violent the John Doe Defendants became.
Eventually the guards snapped, according to the lawsuit.
One or more of the John Doe Defendants slammed Plaintiff Cheryl Weimar to the ground and while down, they brutally beat her with blows to her head, neck, and back, it continues. At least one John Doe Defendant elbowed Plaintiff Cheryl Weimar in the back of her neck, causing her to suffer a broken neck.
The guards then allegedly dragged Weimar like a rag doll to a nearby wheelchair, allowing her head to bounce along the ground along the way before taking her outside the compound so they could continue their brutal attack in an area that was not covered by surveillance cameras.
The lawsuit says Weimar is now a quadriplegic who has to breathe and be fed through tubes. She is seeking compensatory damages, including for permanent physical injury, disfigurement, and emotional pain and suffering
for attorneys fees and costs incurred in connection with this litigation, and for such other relief as this court deems appropriate.

We recognize that preliminary reports from this incident are concerning, the departments secretary, Mark Inch, said in a statement to the media".
Concerning? This woman is now a quadriplegic with a breathing tube! All of this because she had a hip injury that made it painful to bend over and clean a damn toilet.

The deprivation of rights under color of law is a federal criminal offense which occurs when any person, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person on any U.S. territory or possession to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens (18 U.S.C. § 242). When two or more persons conspire to prevent the exercise of constitutional rights, or to punish an individual for having exercised them, it is deemed a conspiracy against rights (18 U.S.C. § 241). The death penalty is applicable in extreme cases when the crimes cause the death of the individual being deprived of constitutional rights. [5][6]

(7,537 posts)There was a 6'6" 275 lb. red-haired deputy in that jail that would select someone from the cells each night and beat them to within an inch of their life. It happened again each night I stayed there.
