The GBI says Butts County deputies responded Halloween night to three 911 calls that were minutes apart. The first reported an angry customer, the second reported a fight and a third reported shots had been fired.
Responding deputies found 27-year-old Nicholas Phinazee Bryan mortally wounded. An investigation determined that Bryan "was using racial slurs" toward 36-year-old Robert Lewis Henderson Jr. and 39-year-old Antonio DeMarty Evans. Waffle House staff told Bryan to leave. Then their argument became physical. Police say Henderson fired a single shot at Bryan, who later died at a hospital.

(8,848 posts)...there isn't enough info in this short article to say that a gun was used just to silence name calling. The name calling led to a fight according to this article. No way to know how bad the fight was, how big the name caller was, what, exactly, he did or tried to do in the moments before he was shot. Just not enough info.

(16,820 posts)to go eat at the Waffle House, but if someone starts a physical altercation with another person who happens to be armed, I can understand why the belligerent one would get shot. As long as the gun owner was within his rights to carry a gun legally, I think this was a simple case of self defense.
It turns out people here dont like violent racists. Does anyone have any pearls I can clutch?

(11,949 posts)College for me. It could have gone bad. Luckily no one died. Because life is not the movies. A fist to the head from a large man can easily kill you.
Listen, I dont support easy concealed carry laws. Not everyone should be Able to walk around with guns.
And I support very stringent laws on all semi-automatic firearms
But if it is legal the people I most wanting to be able to legally carry are African Americans

(31,261 posts)The situation covers things that we have tended to have concerns about, many guns in society and using "stand your ground" as a legal defense after shooting someone. To see people basically celebrating the use of both because a racist asshole ended up dead is disconcerting.

I wonder if the shooter will claim a stand your ground defense? It's GA.

(31,261 posts)guess stand your ground will be claimed. That is sad, people are too quick to shoot instead of saying "man, I have a gun in my hand, calm down and let's talk this out". A person should shoot first only if the other person has a knife or gun, or other weapon that can do serious harm.

(31,261 posts)One of the issues that I have with stand your ground laws is they place almost no requirement on a person holding a gun to exercise restraint if the other person is unarmed (even an unarmed racist asshole).
Since the shooter was Black and the dead man a young White man, it would be interested how this turns out in a stand your ground state. I believe those laws allow a person to shoot a third person to protect a friend who is being attacked, which looked like the case in this situation. The shooter and the guy who was fighting with the dead man were not arrested on the spot, they turned themselves in after the Georgia State Police issued a summons for their arrest - I wonder whether this was done in other cases where the shooter was White?

(31,261 posts)I thought that the law says that if a person seriously fear for the safety of another person, a gun can be used and stand your ground evoked. So if the second Black guy feared for the life of the first Black guy and shot the man, wouldn't that be covered under the letter of Georgia's law?
I honestly think that he should not have shot the guy, just told him that he had a gun and to get away. But the same can be said in most stand your ground cases where an unarmed person who was not doing a property invasion is killed.

The guy was an asshole. He didn't DESERVE to DIE.
The people who shot him might actually have a legal defense if he physically attacked them.
But reliance on guns and violence to solve problems is a HUGE problem in our society. It's just... yuck.
