In the interest of complete disclosure, I am a retired JAG, so the Law of War and military discipline is perhaps more important to me than some.

In my opinion, given the concept of command responsibility (see, war crimes conviction of Japanese General Tomoyuki Yamashita), all persons in the chain-of-command - up to and including the CinC- are responsible for maintaining discipline for the purpose of maintaining obedience to the Law of War. Failure to maintain such discipline makes the chain-of-command criminally responsible for war crimes by troops under their command.

The current CinC has made it clear that the US will not enforce the required discipline. In turn, this makes it impossible for subordinate commanders to maintain the required discipline.
