And makes abortion illegal, I believe the country would support and demand the expansion of the Court.
It may be about time to bring the expansion discussion into the mainstream.

(58,441 posts)It would allow states to make it illegal through legislation and raises the possibility of a bill going through Congress to make it illegal nationally, but it wouldn't automatically be "illegal."
The fight goes on.

(45,786 posts)If Roe is overturned, states could make abortion illegal while others could continue to provide.
What could also happen is Republicans trying to get a federal statute that comprehensibly outlaws abortions in all states. In any case, states will be challenged by regulations to limit or abolish abortion.
Finally, once Roe is gone, expect the next war to be focused on birth control. One can hole Roe could be re-installed by a future USSC.

(51,974 posts)Roe v wade is the goose that laid the golden egg when it comes to fundraising. They just love to hate it.
So far. They've shown they can make abortion really, really hard to get in any state that opposes it, notwithstanding roe. So why would they get rid of it?
More likely, they'll just continue to make it easy for red states to make it virtually impossible without making it actually illegal.
