HEADS UP: Barr taking over E. Jean Carroll case is effort to have it DISMISSED



Just to be clear, DOJ's argument that Trump was acting "within the scope of his employment" when he defamed E. Jean Carroll is not an effort to *take over* defense of the suit; it's an effort to have the suit *dismissed*—because the government itself can't be sued for defamation.




No. If the substitution is successful, they will move to dismiss under 28 USC s. 2680(h), which creates an exception to the waiver of sovereign immunity for, among other things, defamation claims
