AK Senator Murkowski said today she won't confirm a new justice until after inauguration day

Alaska's @lisamurkowski said today she won't confirm a new SCOTUS justice until after the inauguration day. Fair is fair, she says. My colleague @kcgrove will have a story shortly.

There’s precedence for her bucking republican pressure. I hope she does this time too... but she’s not enough is she? How many need to agree not to vote before inauguration for it to work?

She needs to if wants to have even an ice cube’s chance in hell of holding her Senate seat (and it won’t work). And I can see Romney doing the same thing. We have to hold out a little hope.

Even if romney, murkowsky and collins all hold out.. that makes it 50-50 and pence decides it.

However.. given that at this point their most realistic plan for success involves having the supreme court completely stacked and then overriding the vote to deny bidens victory.. why wouldnt they just offer to do the same for collins, thus negating her need to legitimately win, and removing any reason for her to even pretend to be on the fence?

Hickenlooper is up in polling by double digits. https://projects.fivethirtyeight.com/polls/colorado/. I don’t think Cory Garner can support the filling of the vacancy on SCOTUS. Grassley previously has said that he wouldn’t fill a vacancy in an election year. https://nymag.com/intelligencer/2020/08/supreme-court-ruth-bader-ginsburg-mcconnell-murkowski-grassley.html. Whether his tune now is going to be an issue for him. I’m not sure this will even get out of Committee until after the election. What happens in a lame duck Senate if we are lucky enough to take the majority may be an issue. But it also will have lasting percussions for the Republican Party forward.

This obviously does change the dynamic of the upcoming election, and will GOTV for both major parties.

I'm not counting on this until she actually does it.

That said, if 4-5 GOP Senators could be convinced that this was the only way to avoid Biden expanding SCOTUS, maybe it will prove to be the start of something.

He's moderate on some things but very conservative on social issues. He probably wants a conservative in that seat. I'd look more to vulnerable swing state senators like Collins and Gardner.

Apparently Romney says he won't vote to confirm anyone before Inauguration Day either. We just need one more...

Good news on the one hand. On the other hand, this will galvanize Republicans, including those who were squeamish about Trump. Scalia's open seat is probably part of why Hillary lost in 2016.

There's still enough Republicans to confirm a nominee by a simple majority.

Even if Collins defects, that's still 52 Republicans. There'd have to be two more Republicans for it to really become interesting. I don't see two other Republicans out there, even if Grassley said prior to RBG's death that he would not support appointing a new justice during the campaign.

Leaves her with a lot of slimy wiggle-room.

Meanwhile, McConnell is claiming that tRump's nominee will get a vote on the Senate floor ASAP. The far-right is calling for a tRump appointee to be confirmed very quickly 'to prevent the election from being stolen'.
