That's the major worry.
The Senate is only in session three more weeks before they're done until after the election.
I'm sure McConnell can reconvene, but I don't think he will.
Not with everyone having to go back home and get reelected.
What is likely to happen is that Trump will nominate someone. Probably Monday. McConnell will begin the process of hearings but to be honest, the Senate is only in session all of next week, three days of the week after and only one week at the first of October. Not enough time. Even with an expedited hearing.
Then they'll go off and do their things, we'll all vote, and the senate resumes its session on Nov. 9th, where they'll begin the hearings and they'll put it to a vote in December before recessing.
THAT'S my guess.

If they push the nomination through after election day, that should be the primary justification Dems cite when expanding SCOTUS.

(34,857 posts)Or they're going to have to cut into their recess time significantly and a lot of senators up for reelection are not going to sign off on that, especially those who are in a tough reelection campaign.
It's possible it happens but that is really cutting things close. And he risks alienating his caucus and not getting people like Romney, or Collins or even Graham on board with a pre-election vote.

(7,715 posts)If the Reputincans do this, the Ds will win heavily at all levels on November 3. Let dear RBG rest in peace today, but go after with this with a vengeance thereafter.
Remember that folks like Collins, McSally, Graham, etc will be forced to say if they are going to vote in the lame duck session as part of their tenuous elections. Either equivocating on this or saying they will vote could cost them, and other Reputincans dearly
If they do vote in the lame duck session, I'm not sure they will have the votes.
But if they do, start impeachment investigations against Kavanaugh and some other dicey judicial pics at the appellate and district court levels (e.g., on perjury during their respective confirmation process), and get ready to add two more justices to SCOTUS.
