They will not vote to confirm by Nov 3

There isn't any need to and it lets some of the Senates troubled repukes be like "see, we aren't really the giant hypocrites you all think we are."

In the month after Nov 3, they will replace RBG with Scalia V2.

Because...

Dec. 8, 2020: Deadline for Resolving Election Disputes. All state recounts and court contests over presidential election results must be completed by this date.

Dec. 14, 2020: Meeting of the Electors. The electors meet in each state and cast their ballots for president and vice president. Each elector votes on his or her own ballot and signs it. The ballots are immediately transmitted to various people: one copy goes to the president of the U.S. Senate (who is also the vice president of the United States); this is the copy that will be officially counted later. Other copies go to the state's secretary of state, the National Archives and Records Administration, and the presiding judge in the district where the electors meet (this serves as a backup copy that would replace the official copy sent to the president of the Senate if it is lost or destroyed).

Dec. 23, 2020: Deadline for Receipt of Ballots. The electors' ballots from all states must be received by the president of the Senate by this date. There is no penalty for missing this deadline.

Jan. 6, 2021: Counting of the Electoral Ballots. The U.S. Congress meets in joint session to count the electoral votes.


They have this long to raise court cases (like in 2000 these would go to the Supreme Court almost immediately) about the slates of electors from swing states with mail in ballots. And in a 5-4 decision the Supreme Court could allow a different slate to be recognized. Could be 6-3... but Roberts seems to be a bit more independent than the fascists would like.

And that is how Trump will "win" a second term and how the Senate will still be run by Mitch.

Now, how do we stop this from happening?

Oh I dunno. Volunteering and voting might be a good start. It’s certainly a helluva lot more helpful than OPs like the twaddle above, which have been done to death.

Flip the senate and then expand the Supreme Court.

The larger the win for Biden (electoral votes) the harder any BS is to pull off because they need to pull it off in multiple states.

Assume that Biden and the Ds win WH and Congress. What about January 3, the day the new Congress gets sworn in? Pence would still be President of the Senate.

That means the new Congress Pence will count the electoral ballots. Does that help in your scenario?

As it means the Ds control the Senate.

However, the fact remains that between January 3, 2021 until January 20, 2021 at 1159am, no matter what happens, Pence remains remains President of the Senate even if Joe takes the White House and the Ds take the Senate and hold/expand the House lead. It is precisely because we lost ground in the Senate in 2018 that Trump and McConnell have been able to get away with, literally and figuratively, murder.

During this time, Pence's role as the Senate's President is NOT ceremonial. He has major powers in case of a tie vote, as he can vote to break that tie.

Getting the biggest majority possible in the Senate should be one of our obsessions, in addition to Joe getting the White House and the Ds holding the House. Even for these three weeks in January 2021, Pence could wreak havoc as he can cast a vote if the Senate is tied on ANY vote.

Mark Kelly, since he would be replacing a Governor appointed Senate seat.

But yes, we could possibly retake the Senate on Jan 3.

I think if they try to ram through a replacement for RBG before Nov 3, it would anger enough people that many close Senate races would be lost to Repukes... which is why I don't think they will try that.

But they don't need to have someone on the Supreme Court on Nov 3. The President is not elected on Nov 3. Only slates of electors are elected on Nov 3.

Of course we will all go vote... and even though I am older and have diabetes... I plan on voting in person to insure that on Nov 3 my vote is counted. I will vote early to avoid people.

Next week I am going to contribute $2,000 to various Democratic campaigns... $1000 to Biden / Harris (which I believe will max me out) and $200 to each of 5 other races. I am trying to decide now which races (Katie Porter is set... still thinking about the other 4).
