he GOP has asked the Supreme Court to review a Pennsylvania ruling that extends the mail-in voting deadline for the presidential election, a move that could lead to the courts first test since the death of Justice Ruth Bader Ginsburg, law experts say.
Pennsylvanias Supreme Court ruled last week that there will be a three-day extension for mail-in ballots as long as theyre postmarked by 8 p.m. on Nov. 3, Election Day, on Nov. 3 by 8 p.m. Previously, ballots were due when the polls close on Election Day but the states Democratic Party filed a lawsuit to push back the deadline. Republicans have argued that expanding mail-in voting could give Democrats an unfair edge in the election.
The Pennsylvania court wrote that ballots received within this period that lack a postmark or other proof of mailing, or for which the postmark or other proof of mailing is illegible, will be presumed to have been mailed by Election Day unless a preponderance of the evidence demonstrates that it was mailed after Election Day.

(6,283 posts)The vote will have to be 5-3 to overturn the lower court. A 4-4 leaves it stand.
If the can get 5-3 today they would have had 5-4 last week.
This is why the rush to confirm...with 8 you risk letting lower court decisions stand.

(5,253 posts)I'm not sure that SCOTUS really has the ability to review Pennsylvania's decision. But I suppose the GOPpers will invent some grounds involving the U.S. Constitution because votes for federal office are affected. Basically a replay from the Bush v. Gore playbook.
