They can do that because they are not complicit in any way shape or form. It would be the Democrats fault for criticizing his batting technique along with their threat of upsetting norms by threatening to enforce the rules against baby bashing. Besides, they will make sure no white babies are harmed.

won't wind up with you in prison unless investigators can prove you have taken substantial steps toward completing the crime.

unfortunately it's not impeachable until he does it and that's what was suggested in the OP.

In a rational world, a U.S. president telling 20,000 lies or deceptions to our public would be grounds for impeachment but that's not the reality we live in today.
