Legality of NV delay is questionable?

Is the counting 'pause' legal in NV?

NRS 293.363  Preparation by counting board to count paper ballots.  When the polls are closed, the counting board shall prepare to count the ballots voted. The counting procedure must be public and continue without adjournment until completed.

2.  Counting of absent ballots must continue through the seventh day following the election.

Nevada Explains Its Pause on Announcing Further Election Results

A Nevada election official said that county officials need to focus on counting ballots instead of continually publishing updates of results, which is why the state won’t release further results until Thursday.

It takes time for county officials to securely send each batch of results to the state’s election division, Wayne Thorley, Nevada's deputy secretary of state for elections, said in an email. To increase efficiency, state election officials instructed counties “to just count all day and not worry about sending us partial results in batches,” Mr. Thorley said.


Now they say NV hasn't stopped counting, just announcing results. Still doesn't seem to satisfy the 'public' requirement.
