If you recall the Pennsylvania Supreme Court gave 3 days after election day to get the late arriving ballots that were postmarked by election day.
So it's up in the air on whether those would ultimately be counted.

(4,845 posts)I think it would be irresponsible to include them in the total without separate mentions since they know there is a current lawsuit. But I don't know the details of it either, whether they are counted at all.

(9,888 posts)the provisional ballots. These are actual ballots mailed to people who requested them that were returned too late to make it by Election Day. The provisional ballots have always been a thing. These late arrivers in big numbers have never been an issue in PA because we didnt have mail ins except for absentee until this year.

(10,047 posts)on or before, in case they hear a case to throw them out. They were already segregating them and I would like to hear the number so we know how many. PA officials are saying there are not that many. This is not unexpected. The repubs wanted them to stop counting all together and SCOTUS said no.

(31,261 posts)The Judge may request that plaintiff and defendants do a specific action, but that is not a decision. That Judge then take the matter before the entire Supreme Court and they make a decision, the Circuit Supreme Court then either grant or deny the plaintiffs requests.
Each Supreme Court Judge serves on a Circuit, some more than one, there are 13 Circuit Courts and 9 Supreme Court Justices.

This could have all been avoided if we were allowed to prep the ballots, and trump needs to get ready to leave because PA is going blue.

(7,480 posts)Personally, I think the media and it's statisticians are being way too paranoid. This is beyond careful. It's becoming laughable. I mean, Alaska hasn't been called for Trump yet and we all know exactly how it's going to go. It's becoming very hard to listen to them prattle on as if Trump stands a chance. So, I understand the frustration, my friend.

(34,062 posts)The requirement to keep the ballots segregated was made several days ago. That's the batch of ballots they have been discussing all day as being unable to start counting until 5 PM today.
Trump had asked that they be barred from counting them - that request was not granted. The ballots are already segregated. This changes nothng - at least yet.
In addition - the SOS said that the number of ballots at issue is minimal, and unlikely to change anything whehter they are ultimately included or not.
The next step is for the court to decide whether to hear the challenge. My guess is that when the SOS responds with the numbers of ballots involved and the reality that no matter what the court decides it will not change the outcome the court will decide the appeal is factually moot. Generally, courts don't issue advisory opinions (opinions that advise future disputes when there is no current dispute to resolve.

(3,282 posts)The late arriving ballots are nominal. We are talking about a few hundred or maybe a thousand ballots. Nothing that will change the race.
Furthermore, they are probably more R than other mail in ballots so they are probably close to a wash anyway.
Biden is leading in every contested state right now, R's should be scream to count every vote.

Pennsylvania had argued that they would set aside ballots received after election day and count them separately. Alito agreed.
No ballots are being thrown out and Trump lost the appeal to the SCOTUS.
This is a victory for our side.
