New: The state of Missouri + 9 other states have filed a brief in support of PA GOP. Goes hard on the notion that voting by mail is especially susceptible to widespread fraud, which election experts who study voting trends and behavior say is unfounded

Just In: The state of Ohio files amicus brief supporting Pennsylvania GOP's effort in SCOTUS to discount later-arriving PA mail ballots that are valid under current law

Legislators or judges. PA three day extension was created by the PA judiciary - GOP is arguing that the legislature should make election law.

They know it won’t effect PA but what it can do is set it up so that republican lead legislators can determine voting laws within each state regardless of the state judiciary or the Governor. Most states are run by republican majority legislators. This is part of their long game to restrict voting rights as much as possible so they can retain power well into the future. And a recent dissent I believe that Kavenaugh wrote regarding this exact thing, is leading the way for them. The sooner people realize they shouldn’t ever vote republican the better. I fear it may already be too late. They are shameless and no longer support democracy.

...that haven’t even been included in the totals yet, because SCOTUS ruled them sequestered.

I have little doubt that the packed SCOTUS will rule for the administration on this (although it’s a bad decision for the future), but the only effect it will have on this election is to keep Biden’s margins of victory in PA where it is already, instead of increasing it by a few thousand more. I can only think Trump’s lawyers are hoping for a “Hail Mary” for a Citizens United-style widening of the case by the Court (say, invalidating the extended PA deadline and, while they’re at it, retroactively invalidating all mail-in ballots nationwide, even if they were cast according to the legislature’s instructions), but I really see no way that will happen.

I don't think it matters. From what I have gathered from watching PA returns, there are very few of these ballots.

But we don't need those ballots. They're set aside and as i understand it, not counted yet. Biden wins PA regardless.

... there WAS fraud, but just that voting by mail COULD be susceptible to fraud??? Pretty speculative. That would likely only fly to a judge appointed by Тяцмр. I wonder how many of them might be out there? I’ll ask Susan.

Hawaii was by mail bc of the Pandemic spread that trump is responsible for.

All the states had mail in votes.. are they going to try nullify all of them?
