Don't be fooled. They absolutely have not abandoned Trump. They're doing his work in the guise of representing the party, not him.

(42,531 posts)They want the US Supreme Court to rule that the Pennsylvania Supreme Court acted unconstitutionally when they ruled that ballots postmarked on or before election day but received after 8 pm on election day should be counted.
More generally, they want to establish as precedent that the US Supreme Court can sit in judgment of state court decisions interpreting state election law.
You know who else wants that result? You know why?

Specifically, does "Legislature" mean the state legislature exclusively, or the state legislature as interpreted by the state courts. The claim is that the PA Legislature (the body charged with setting out the manner electors are chosen) expressly rejected the possibility of extending the deadline. The courts (not the Legislature) extended the deadline for 3 days.
So it has nothing to do with whether the Supreme Court can sit in judgement of state court decisions, but whether the details of choosing the electors (allocated by the constitution to the state Legislature) can be altered by the state courts.
