I understand that this horse is deceased, but---

A federal court just ruled that Chad Wolf's suspension of DACA was INVALID because his appointment was "unlawful" and he therefore lacked authority to act as head of DHS.

If Trump was only placed in the White House by virtue of illegal voter suppression and the solicited illegal intervention of Russia, why are the appointments of Gorsuch, Kavanaugh and Barrett not INVALID?

I'll sit down now.

4. Denying Trump's Legitimacy

The problem is that the Senate did approve his nominations for SCOTUS. It would be nice to be able to roll back everything Trump did and the basis of his involvement with the Russians in 2016 (and beyond) but politically, it ain't gonna happen. Where Trump failed with Wolf was that he never submitted Wolf to the Senate to be confirmed, since McConnell didn't want the political theater and Trump liked the extra power that came from having someone loyal to him, not the Constitution. It's the lack of approval that's the problem, not the illegitimacy of the action.

Biden should absolutely do the same, until some balance can be restored.

seated POTUS can act legitimately. I agree that a roll back "ain't gonna happen", but that does not mean that it shouldn't.

At 71, I guess I am just no longer willing to accept "that's the way things are". Not an exact quote, but JFK's words still ring true to me: "Some consider the way things are and ask 'Why?' I consider how things could be and ask 'Why not?' "

Thanks for your response.

Because he won in 2016 by a vote of the electoral college. Wolfe was never passed by the senate

Acting appointments are prefectly vlid up to a point. But there are limits.

Appointing Wolf as "Acting" wasn't illegal. Leaving him there as "Acting" for four years was.

Do people really think Joe and his team are not smart enough to follow the rules? Or even to make the rules work for them (for example, by appointing increasingly progressive people at each deadline until the Republicans get scared)?
