If they refuse to hear it, can he appeal that to The Supreme Court?

Appeals to the circuit courts are not discretionary, so they will have to hear it.

Correct, though the appeals court can issue a very bare-bones affirmance of the district court

(115,281 posts)2. Appeals to the circuit courts are not discretionary, so they will have to hear it.
Typically these appeals first go to a three-judge panel but those can be appealed to the full court of appeals. Their final decision will be heard by the Supreme Court only if they agree to hear it by granting the appellant's cert petition.

They may need another lawyer to file papers at 3rd circuit as Giuliani is not admitted there and the only attorney currently on the case who is is designated as inactive
