(7,611 posts)In CT would advise not to. There are no consequences to a refusal. The cop has already decided to arrest you when he asks you to get out of the car. There are consequences to your license if you refuse a breath or blood or urine test.
I don't know about other states.

(4,429 posts)From experience- the whole raise the leg thing is the one that I simply cant do, even sober. Im 350 pounds, 61 years old, with very bad arthritis in both hips, and I have trouble standing on two legs, let alone on one. I have to use canes to walk anywhere.

Not saying she wasn't under the influence, but both balance problems and not following instructions in detail do have common causes other than inebriation. And a grandson having to see grandma being pulled over by the police and the disaster of a famous husband running for governor would be understandable causes for disconbobulation.
Whatever. I despise Allen West, and a wife who shares his views and ill-gotten gains every bit as much. Occurs to me, though, that if her husband was a Democratic candidate we'd all be wondering if it was a setup, regardless of wandering out of her lane and including breathalyzer results.

In a tried and true move to prove innocence to his own factionalists, "livid" Allen West is outraged!, demanding an apology from apparently the entire top government of Dallas and that the officer be fired.
Results of a blood draw post arrest are pending.

It looked like the crazy neuro tests that I have had done...One condition I have is a herniated disc..
I did not watch the rest of the test....
Didn't watch her driving at the beginning....
ETA Now I see that she did the breathalyzer, but did she fail?

(42,661 posts)And like a few others, I don't see evidence in the video that she was obviously drunk. I've been pulled over and forced to do a breathalyzer test and when it didn't register an unlawful level, the cops made me do it again. And again. For some cops, when they pull you over, they've already decided you're under the influence and they will try anything and everything to justify the stop.
The blood draw results should give an answer, but I won't be surprised at the result either way.

I will say that it looked unlike any drunk drivers video Ive seen
but I suspect that the only ones that make it too common public view are drunk enough to be entertaining.
Ill keep an open mind. Her story seems consistent with the video - but the blood test will be conclusive.

They had to get a warrant for a blood draw. That's why she wasn't released until the next afternoon.
She didn't follow instructions on the roadside tests but they are hard to do. It looked like the cop did the test with the flashlight wrong. They are looking for a sort of bouncing of the eyeball at the extremities which I didn't see when the camera show ed her eyes. I think the cop did her version of the test twice so I may not be the only one that didn't see the eyeballs jerk. Maybe the breath test didn't show anything so the cop kept making her do it.
She's not obviously drunk. She might not be guilty.. By the time the cop asks you to step out of the car they have already decided to arrest you.

Of course
that could also be someone trying to play act and pretend that she doesnt understand
to avoid a valid test.
Odd that the video skips over the conversation re: why she was pulled over and whether she had anything to drink.

(7,611 posts)They must have been flashing the overhead lights for awhile. She stops behind a truck stopped at a light I assume. It's a bit bizare she stays in the middle of the road rather than pulling over.
The blood draw may have been done so long after the stop it may not show her over the limit if it shows anything. Probably she skates..

(16,950 posts)at their phone. Most of the time I pass someone obviously weaving and leaving huge traffic gaps, I look and see they are looking down at their phone.
A post here says the breathalyzer was inconclusive and she refused a blood test. If she was just on her phone, it seems she would have explained that and taken the chance on a ticket instead of arrest. But that field test also looks like it could be someone with balance issues in general.
I used to do high impact group exercises at the gym and could keep up with everything except the one-legged stretches at the end where you have to raise a leg to hold it and stretch, but I just couldnt balance. So it wasnt that shocking she couldnt balance.
Well see what the bloodwork says.

Some reports say that she rejected the blood test, but one was performed. The results will tell the tale.

(21,856 posts)could set the timer. the cop would say to do something, Mrs. West would start and the officer would say wait till I tell you to. over and over. I would've been a nervous wreck, I probably would've cried too, I wouldn't do well with that kind of pressure.
I think this video is kind of brutal.

(25,201 posts)And the balance part of the neuro test also checks for complications of radiculopathy...which is often caused by a herniated disc without any cerebral cause...

(9,064 posts)I hadn't been drinking, but I had been working a lot that week on very little sleep. I was on my way home to pass out entirely for two days. So, I was a touch out of it.
I snapped fully awake once that field test came up, but I couldn't figure out what he wanted me to do. He kept correcting me. It wasn't clear at all. I kept looking around and repeating, "Wait, what?" I must've seemed out of it.
Anyway, I explained things, blew nothing. So, he told me to go home and get some sleep.
Still, it was anxiety-inducing and somewhat confusing at the time.

Absent that, she was probably distracted either by a phone or more likely the kid. That may be why she was driving over the line.
That said, I hope they find evidence and she gets locked up.

(7,589 posts)Over the right of the white line, sitting there for awhile in the middle lane while being instructed to pull over from the police flashers.
Once she gets out of the vehicle, she completes the field sobriety tests just fine, even with incoherent instructions. She doesn't have slurred speech and looks frightened more than anything.
Angela is slightly older than I am and I can't do the sobriety test walk or positions without losing my balance. It is possible that she's a diabetic and had a drop with her blood sugar which could also explain her erratic driving. I know several drivers that have been pulled over in the past while having a diabetic blood sugar drop. Their breath can smell sweet and they appear intoxicated.
If they took blood samples, I guess we'll have to see what the results were.

(7,611 posts)Highway she just would have gotten a ticket. The cop decided she was drunk because of that. I guess they have the receipt showing no alcohol. I just going to guess the blood test shows zero.

I'm thinking she may have had a drink or two and did not want to do the test.
However, I don't get the impression that she was impaired.

I will say she was reasonably cooperative and give her extra points for not once saying "Do you know who I am?"
Stopping in the middle lane was not a good move.
