Justice BREYER considering retirement. Doesn't like decisions about himself. Do it for us.

Sincere thanks to him for his service and record, no disrespect intimated about him here, the disrespect being to the system of lifetime and political appointments.

The source for the core interview is behind a NYT paywall.

Justice Breyer admits he’s considering retirement amid calls to step down

.... “There are a lot of blurred things there, and there are many considerations,” he said, adding, “I don’t like making decisions about myself.”

As he faces the decision of retirement, progressives have also put pressure on President Joe Biden to expand the court to counter its 6-3 conservative majority.

Breyer told the New York Times that he was “wary” of the push to expand the court, adding that it could send the public a message that the court is a political institution. ....

If a vacancy in the high court occurs during his presidency, Biden has vowed to nominate a black woman for the spot.

Surely he understands that the decision is not about himself.

But 3 Liberal justices, and All of them Female?

I'm fine with appointing someone black, but perhaps a black male, to counteract Thomas?

Again, I'm not against someone female, but feel there needs to be at least some male representation on the liberal side of the court.

Maybe if good ol Clarence croaks. We can replace him with a black liberal man. Poetic justice if Biden were able to replace his seat

No chance he would resign anytime soon, but death will work just fine.
