I suspect it is more likely to be the latter. I can see the right being the dog that chased cars and finally caught one by the tail pipe.

(4,391 posts)Can the GOP hold power with 40 percent support through suppression, violence, money, and regional support? This will surely do nothing to endear them to the other 60 percent. But if the tables ever do turn, I hope we use whatever tools the USSC gives them against guns and corporate overreach.

(33,643 posts)Just because there's a law that says 'you can sue' doesn't mean anyone will be able to successfully do so.
Seems like if the first few cases come in and judges just go 'naw, this is frivolous, you're not getting $10K for reporting an abortion' ... people will stop suing.
Think about how FLOODED the already overworked court system will be if they start handing out free $10K to everyone who 'tattles' about an abortion? There would be a freaking deluge.
I don't know that even the Con judges are going to like this idea.

(24,406 posts)There's almost no way that this is going to be workable/enforceable. Also, it is bascially a "back door" abortion ban as most women don't even know they're pregnant at six weeks.

Their initial statement was that they would be forced to obey the law... but that might just be a position they take to make the emergency appeal work.

Which still sucks of course.
But I wonder how much the state's judges are going to care for the legislature basically forcing 'standing' onto them. That's supposed to be their purview.
If ANYONE in the USA can sue, basically there could be 100000 cases filed for every abortion that happens where someone blabs on the internet 'my sister got one!'.
I've a feeling they'll quickly decide on 'no money for you' for the first few cases, in hopes of stemming the tide and rejecting the governor and legislature's f***ed up move.

Another thing they have on us that few mention or remember is that when Roe vs Wade was decided, the old laws were left in place in many places that is, Roe became the law of the land, but previous laws were not repealed by each individual state legislature. Comes the day that Roe is completely overturned, theyre back.
And then theres the 300 pieces of legislation around the country that are poking at state legislatures like a swarm of sperm around a ripe egg. Just as with the proposed voting-restriction laws, theres a lot of them and they are persistent.
For decades and decades the anti-choice fanatics have been plugging away at this. Shame and prayers outside clinics is only part of it. Killing doctors and terrorizing clinic staff members by doxxing them and stalking their children is only part of it.
Year by year, they have passed more and more extreme legislation legislation that when presented on a ballot to voters actually fails to pass, but when presented in a state legislature ends up getting through. The end goal is to pass it up along to SCOTUS, and to keep doing so until the Court changes. Thats how they gutted the Voting Rights Act.

I dont know where it goes from here. I think everything (democracy, the republic, a womans control over her own body) stands on the edge of a knife. My only comment about left wingers defending a womans rights is that theyll end up being the death of us. Democrats are on our side, yes. But the further left you go, the less some people can see that voting for Hillary Clinton (or Al Gore or Barack Obama or Joe Biden) to save the SCOTUS is a priority. And look at SCOTUS now.

(4,516 posts)They won't stop with abortion rights, its' never been about babies. It's always been about controlling women and punishing any who won't bow to men. They won't stop until once again, we have fewer rights than their cattle.

(26,727 posts)There is no "upholding" of the law possible today. The only decision is whether or not to stay enactment while a court challenge is considered.

(4,104 posts)I was 22 when Roe was handed down. There are now two generations of very empowered women who have come up after me, and theyre use to rights being given, not taken away. They aint gonna go down so easy. Expect a epic battle.
