Sounds like the power rests with the Federal courts (SCOTUS has already sat on its hands on this one), while the lawsuits will be brought in state and county courts, I think.

They could have secret Tribunals, with jurors wearing black robes with hoods.

This will be a handy protocol to have in place for when they ban heresy.
