Justice Samuel Alito on Thursday bristled over recent criticism of the Supreme Court's handling of emergency matters under its so-called "shadow docket," a phrase the justice said plays into a warped portrayal of the court as a "dangerous cabal."
The staunchly conservative 71-year-old justice said he welcomes substantive debate over the court's rulings, but takes exception to what he characterized as a distorted depiction commonly found in media reports on the court's emergency activity.
"The catchy and sinister term 'shadow docket' has been used to portray the court as having been captured by a dangerous cabal that resorts to sneaky and improper methods to get its ways," Alito told students during a speech at Notre Dame Law School.
"And this portrayal feeds unprecedented efforts to intimidate the court or damage it as an independent institution," he said.

(11,006 posts)They think they are not setting precedent (they don't believe their own bullsh*t), and they don't have to write a bunch of stuff. And how dare anyone criticize them; he actually called out a reporter from the Atlantic for criticizing him in his speech at Notre Dame today.
Saying the court is not a dangerous cabal is exactly what someone in a dangerous cabal would say. Stormtrooper Sammy has learned his gaslighting lesson well.
And not a word about the emergency request from Texas on January 6th. Agan, they thought they could rule from the emergency docket. Pelosi was too quick and too smart for them this time.

If ,instead, their goal is to enforce a certain political philosophy there should be a way to deal with that. That is a terrible abuse of power.

But we can expand the Court (if we get SineManchin out of the way) by killing the Filibuster. That is a MUCH lower bar.

Once we set the precedent, the right might indeed expand it again, further diluting individual power. Then we do it again. Eventually, there's a large body that no longer hangs like a sword over us. They won't be able to pull the midnight bullshit.
We'd probably build some additional safeguards into the legislation. For example, term limits, ethics rules, limitations on their jurisdiction. All of that is allowed in the Constitution.
