(11,032 posts)McDougal defied a subpoena from a federal grand jury, for which a contempt citation is an easy proposition. A grand jury subpoena is a writ of the court, which the court will be disposed to enforce. Enforcing a congressional subpoena is more complicated and something the courts would prefer to avoid.

If we don't incarcerate, they will eventually assume control and throw our key representatives in prison on trumped up charges.
If the second supposition is correct (and I think it is), then I think we have no choice. Either way our goose may be cooked if they take over Congress and the White House. Might as well expose them now for the vermin they are and let the chips fall as they may.

Tough tickies if they don't like it. Please remember, the only 'fascists' around are the rethugs. Don't let them command the conversation.

(2,585 posts)As far as I know, congressional committees don't (really) have the physical capacity to incarcerate anyone who defies a committee summons. What facility exists in which this might happen?
Don't get me wrong. I believe these chucklehead Molotov bombers to the Constitution need to meet the consequences of their wrong-headed beliefs and their fascist actions to the nth degree. But there is nothing really that can be done with them unless criminal charges are brought against them, and Dems can't do that.

You can SAY you went in and sat before the committee. The fact that you SHAT ON the committee just becomes the new how-to! Its the real-life immunity from any consequences.

Her refusal to answer "three questions" for a grand jury, on whether President Bill Clinton lied in his testimony during her Whitewater trial, led her to receive a jail sentence of 18 months for contempt of court. That made up most of the total 22 months she spent incarcerated.

The Justice System has been corrupted under Bill Barr and I don't know if it can recover?

(2,686 posts)the only question worth asking is why? If its because no action is taken against them because the Dems dont want to seem overly harsh, we are all likely screwed.
But if the Dems are unable to pursue criminal contempt charges because of some statute ot codicil of law, then the Dems ought to find a way around it, or at least try.
