On Tuesday, U.S. Treasury said two programs created by Ducey in August appeared to violate rules for American Rescue Plan stimulus dollars. In a letter, Treasury officials said that money could be clawed back if Arizona does not respond or change the programs.

One program dedicated $163 million to districts that did not impose COVID-related mandates, such as requiring masks or unvaccinated students to quarantine. Another $10 million was set aside for vouchers of up to $7,000 for families who wanted to move their children from districts with mandates in place to schools where there were no mandates.

Since the programs were announced, the state law prohibiting those requirements was temporarily stalled by legal challenges, allowing schools to impose mandates.

As that court case continues, and despite Treasury's warning, Ducey said he would consider adding more funding to the program that gives families money to move their children to schools with more lax public health protocols.
