Texas civics teacher in the US on asylum was sentenced to 12 month probation for his role on 1/6

A Texas civics teacher charged in the January 6 Capitol attack narrowly avoided jail time after he struck a plea deal - but the man's delicate immigration status could still be in jeopardy, despite his lenient sentence.

Eliel Rosa, 53, pleaded guilty to one count of parading, demonstrating, or picketing in a Capitol building earlier this year after he admitted to entering the US Capitol on January 6. Rosa had previously been indicted on five counts, including a felony obstruction charge that carried a possible sentence of 20 years.

On Tuesday, US District Court Judge Trevor McFadden in DC sentenced Rosa to one year of probation, 100 hours of community service, and $500 in damages. Federal prosecutors had requested one month of home confinement.

According to a criminal complaint reviewed by Insider, Rosa, along with his friend, Jenny Cudd, entered the US Capitol on January 6 after attending then-President Donald Trump's "Stop the Steal" rally. The two friends had originally returned to their hotel after the rally, but made their way back to the Capitol when they learned that former Vice President Mike Pence had refused to overturn the election, court documents said.

I don't know the details of his involvement of Jan. 6, but I think he's a candidate for deportation.

His green card should be revoked. Other immigrants have been deported for less, even after serving this country in the military. I bet he’s one immigran the right would go to bat for.

I know someone from Mexico, who has a degree from there and she could not get certified because their college system is different.

And this ought to (but probably won't) tank his citizenship request:

By pleading to the misdemeanor charge, Rosa avoided a felony, which would have resulted in a significant threat to any future citizenship. But a US statute that requires citizenship-seekers to demonstrate "good moral character" may still come into play.

"A federal judge on Tuesday morning declined a request by prosecutors to sentence a man who admitted he was present inside the U.S. Capitol on Jan. 6 to one month of home confinement. Rather, Judge Trevor McFadden decided that defendant Eliel Rosa would be sufficiently deterred from any future criminal activity by serving 12 months on probation, performing 100 hours of community service, and pay $500 in restitution.

According to court documents, Rosa, currently of Texas, is in the United States on political asylum. While being sentenced, he thanked U.S. taxpayers for footing the bill for his federal public defender.

Prosecutor Amanda Fretto unsuccessfully argued that “probation should not be the default” sentence for Jan. 6 defendants given the totality of the circumstances which engulfed the U.S. Capitol Complex that day earlier this year.

His remorse seems sincere,” Fretto told Judge McFadden, an appointee of former President Donald Trump.

potential 20 years in prison down to 12 months of probation? Is it simply the guilty pleas that these prosecutors are satisfied with?

Besides going in with the gang, I don't think Rosa did anything that drew attention to himself. Most of those charges are trumped up.
One reason for plea deals, is so that the govt can get info about other suspects from you.
