Judge applies 'terrorism enhancement,' sentences two Neo-Nazi group members to 9 years

A Maryland judge applied a "terrorism enhancement" to the sentences of two Neo-Nazi group members, giving them a total prison sentence of nine years each on Thursday.

U.S. District Judge Theodore Chuang said that he would be applying the enhancement to their prison sentences because he claimed that the "passion" and "virulence" to take down the U.S. government and murder lawmakers was evident in conservations captured in the two men's apartment by a microphone and a closed-circuit television camera, The Associated Press reported.

Some of those conversations between Brian Mark Lemley Jr. and Patrik Jordan Mathews included murdering a lawmaker in Virginia, devastating power lines and rail lines and freeing mass murderer Dylann Storm Roof, who killed nine Black church members in Charleston, S.C. in 2015, according to the news outlet.

Roof was sentenced to death for that crime in 2017; he recently lost an appeal.

Too bad this article is/was badly written/edited, he's a U.S. District Court Judge, NOT a 'Maryland judge.'

For many charges sentencing options can be limited. For others, as this case illustrates, judges have more discretion to apply enhancements when those enhancements are part of the available options.

On a lighter note, the 'terrorism enhancement' made me think of the old movie, LA Story, when Steve Martin ordered a 'double-double decaf half-caf.'

So the DOJ prosecutors could and SHOULD order up the equivalent - a double, double sedition sentence with a terror enhancement. Seriously - that one guy who got sentenced to 5 years probation? What BS.

The judge who sentenced Mathews and Lemley to prison concluded that they intended to engage in terrorist activity. U.S. District Judge Theodore Chuang’s decision to apply a “terrorism enhancement” to their sentences significantly increased their recommended prison terms under federal guidelines.

Chuang said recorded conversations between Mathews and Lemley captured the “virulence” and “passion” in their willingness to kill people and bring down the U.S. government.

“The court rejects the notion that this was merely talk among friends,” the judge said.

Prosecutors recommended 25-year prison sentences for both men. Lawyers for each defendant sought prison sentences of 33 months.

more like a school to indoctrinate others to white supremacy and anti-government sympathies. Of course, all they get to listen to is fox news, so it only ramps up their anger.
