Where the fuck is Garland?

The J6 Committee did a fucking spectacular job last night.

But for me it just made it fucking spectacularly clear that Merrick Garland has had 18 months to do anything at all about an attempted coup by the former president and has done nothing. And spare me the oh but theyíve charged lots of the Nazi shitheads at the battle of the capital. They donít count.

J6 cannot indict anyone. They cannot even enforce subpoenas (thanks again Merrick!)

The fate of the republic is in the hands of the General McClellan of AGs. And if you donít get the reference look it the fuck up.

Yes I am fucking pissed off.

25. A grand jury has been empaneled since February

but they forgot to inform Voltaire2 on DU of their progress.

You don't start at the top with a case like this ó and there has never been a case like this.

The evidentiary bar for the DOJ is much higher than for Congress. The committee can simply say all signs point to Trump. Garland has to prove it, and he has to use cooperating witnesses, not simple assertions. Every step must be rock-solid or it won't survive in court.

I feel a bit better about the DOJ after last nights presentation. Several times the presenters telegraphed actions leading to criminal indictments. Itís also obvious the DOJ is casting a very broad net.

Some of us don't find it funny that after a year-and-a-half that so little seems to be being done about it.

Furthermore, some of us don't find it funny that the likes of Meadows and Scavino were let off-the-hook for defying the congressional committee.

But hey, let's pull out the emojis and laugh at those of us upset about it, eh? That'll unify the party, for sure!

16. jeebus fuck, would you rather he rushed to make arrests that fell apart later on ...

... and we're left with nothing?

Did you not see the mountain of evidence the committee has already put together? We've only seen a smidgen of it. It's only the first hearing, for fuck's sake. The DOJ is going to rely on a lot of what the committee presents.

Do you remember Garland's concern for politicization? If he rushed to prosecute everyone involved according to your timeline, it would be 100% political retribution, banana republic style. I get it - that's what you want. Political retribution. But you can make that claim; Garland can't.

The DOJ has already indicted hundreds and hundreds of insurrectionists and they're working their way up the chain. They indicted SIXTEEN people for seditious conspiracy and they're getting closer and closer to the top of the crime heap. FOUR of those have already pleaded guilty AND ARE COOPERATING to give them people higher up in the chain of command. This TAKES TIME.

This is how you do it. You indict people and get their cooperation in order to indict those higher up. You don't go rushing in arresting everybody without the kind of evidence you can get from cooperating witnesses, and have your case fall apart because you didn't take the time to gather evidence. Hell, even Watergate took two years.

It's gonna happen. Too bad you can't see it because you're blinded and impatient.

19. (sigh) the absence of public information is not evidence of inaction or dereliction of duty by DOJ

You clearly havenít been paying attention (or only looking for indictments, mug shots and perp walks).

The bulk of the physical evidence has only been available to the committee, and to DOJ, since the the SCOTUS ruling on Trumpís privilege claims in January . This includes all of Eastmanís incriminating documents.

DOJ empaneled a Grand Jury(ies) in February , and has been calling witnesses from Trumpís inner circle, the fraudulent electors scheme and the VIP section of the January 6 Stop The Steal rally. No, we donít know the names of who has been subpoenaed.

Crimes like Seditious Conspiracy and Obstruction of an Official Proceeding are extremely complex and difficult to prosecute. Garland could rush out indictments to satisfy your uninformed impatience, but then would likely lose the cases. They just charged the Proud Boys leaders with Seditious conspiracy yesterday , likely because of cooperation deals with Oathkeepers and other PBís.

Yes, I too am pissed, and the survival of American democracy is at stake, but I donít want to see a bunch of rushed indictments result in a bunch of acquittals or dismissals. Yes, I said rushed- it hasnít been ď18 monthsĒ that the investigators have had access to crucial evidence. Also worth noting is that prosecutions of complex crimes take time - John Mitchell didnít go to prison for nearly three years after Watergate, and he was convicted of the comparatively simple crimes of perjury and simple obstruction.

21. Good point

The motherfuckers have been stalling and resisting for so long that it really is only recently that the committee - and the DOJ - have had some important incriminating evidence.

Solid, winnable cases take a hell of a lot of work and time to put together. And in these cases, the investigating entities have been faced with unprecedented obstruction.

We American citizens have to be supportive of, and follow the Constitution and rule of law.

For those of us that took an oath to defend the Constitution it means we also have to obey the Constitution.

Or the Constitution means nothing...and we become "them".

27. This article at Empty Wheel helps to understand realistically how the DOJ

and the committee are working together. The committee can get a lot more information from media sources that will take the DOJ much longer and harder to get under the first amendment. I do not understand this animosity towards Garland when it has become so very obvious he is doing his investigation. Maybe instead of being pissed off, a little reading from the legal community will help to understand what is going on.

snip

"Multiple reports on the January 6 Committee have indicated that theyíre packaging their public hearings up with an eye towards making admissible evidence available to DOJ and other law enforcement investigations. Along with speech and debate and executive privileged testimony, the January 6 Committee has greater ability than DOJ to obtain the testimony of journalists than (under Merrick Garlandís media guidelines) prosecutors at DOJ can.

Thatís why the prominent inclusion of Quested is of particular interest. As of last Thursday, there was just one reference to Quested in the Proud Boy Leaders discovery index (though his work is included in open source videos). But whatever testimony he provides tonight will become accessible to prosecutors, who have just one more week before deadlines on discovery start kicking in.

Thereís one more detail that I expect the Committee to include that has gotten too little focus: the other bodies.

Because QAnon mobilized bodies in less direct ways than the Proud Boys or Oath Keepers, that effort is in some ways more accessible to Congress than to DOJ (because Congress doesnít need to show probable cause to obtain evidence). And thus far, at least, the Committeeís efforts at understanding the role of the 1st Amendment Praetorian ó militia associated more closely with Mike Flynn ó have been more public than those of DOJ."

I was glad to hear a report this morning that the Attorney General watched last night's hearing, and plans to watch the rest of them.

This morning, I e-mailed the DOJ to request indictments & prosecutions of those who planned the insurrection, including the republicans who asked Trump for pardons, and all of those in and around the White House. (See links to DOJ in my OP below.)

1) Building cases with bulletproof evidence that will result in convictions.

2) Expect announcements from DOJ after J6 committee presentations. The case for the DOJ to indict the big fish will be laid out in a way that will be easy for the public in general to understand, therefore minimizing unrest when indictments are announced.
