Today, Merrick Garland confirms there is no memo or legal opinion that in any way would hinder, prevent, or obstruct prosecution at the highest level. He also eagerly says he is watching the hearings as are the Jan 6 prosecutors

watch: (love the part where he patiently explains to the press why those of us outside of his investigation aren't supposed to know what's actually going on:




"We are proceeding with full urgency with respect, as I've said many times before, to hold all perpetrators who are criminally responsible for Jan. 6 accountable, regardless of their level, their position and regardless of whether they were present at the events on Jan. 6," Garland said. "We're just going to follow the facts wherever they lead."

...the DOJ may well be hearing some of this for the first time. The Jan. 6 committee has not released witness transcripts to DOJ before this hearing.

DOJ has been investigating this as long as Congress, and has actual arrests, charges, grand juries, and court cases underway with many of the same perps Congress is highlighting in their hearings.

But DOJ does not coordinate their investigation with Congress, for the reasons Garland stated in his response, except in that it will accept any referral of a crime that Congress uncovers.

Both benefit from each others investigations at arms length, especially the DOJ. It's to avoid any conflicts of interests, but most importantly, to protect the integrity of their ongoing investigations by not tipping off perps to their evidence, which defense counsels can demand from government prosecutors.
