(4,845 posts)DoJ specifically said obstructing an "ongoing criminal investigation". That doesn't mean a sure indictment is coming but it's highly likely.

But Trump going to prison is a long shot.
I think realistically the most we can hope for is indictment and some sort of settlement, home detention and gag order.
But whether Trump adheres to any agreement is doubtful.
I base my assessment on facts to date.

I guess our definition of "the will to pursue TFG's crime" is different. I think getting him indicted is part of "the will to pursue TFG's crime", whether the endgame is prison or not.

Now the dial has jumped for sure, maybe 30 to 50%.
I agree, the bar needs to be set quite low in terms of justice and Trump.
Whatever he gets, it will not be what he deserves.

(15,642 posts)it needs to be set quite high if we want to ensure this doesnt happen again when another R css as putted the WH. Having said that, ceasing his property, stripping him of citizenship, and banishing him from our borders would be sufficient for me. Melanie and her parents as well. Probably a pipe dream, but some extremely significant personal accountability, former President or not (very likely due to Comey and Russian interference keep in mind) is what is actually needed.

Even an illegitimate POTUS like Trump.
So if Trump had been smarter, less crazy and not pissed off Mitch McConnell, Trump would have gotten away with everything.
I like your pipe dream. Mine is that Trump is dropped naked into Gitmo. Never to be seen or heard from again.
I also agree, if there is not some consequence for Trump, then I guarantee that there is another smarter sociopath
waiting in the wings for his shot at a POTUS crime spree.

(1,685 posts)My guess however is this arrogant fuck will fight to the finish. He will not let anybody tell him what to do. He will play all the angles which are all the things Merrick Garland is worried about indicting him for and the fucking weasel will probably get away with it just like he always has or maybe finally somebody will haul off and give him a metaphorical blast that turns the tide against him.
Also there may be some other damning evidence that nobody has heard of yet that theyve discovered in this criminal investigation that will possibly show that he gave some of these top-secret documents info to a foreign adversary or worse yet sold it to them. We dont know any of that yet, were just filling in the blanks at this point.

We can certainly make educated guesses about what he might have done with the stolen material.
Trump is obsessed with money, attention, status and power. It is not his style to steal high value items and
not do anything with them.
I think it is safe to say that there is more damning evidence unknown to the public.

I am looking forward to when Ivanka and Jarred lock him away in an off-shore facility with no internet or phone access. They'll pay some hourly locals to keep him locked in, fed and medicated, with faux snooze blaring in the background....That's probably the deal that will work for them and the world. We can't put him in a prison. It would be overrun with armed magats.

The best way to predict future events is past behavior and current facts.
It is only now that it appears Trump may have some consequences.
He has never faced justice before. Those are the hard facts.

(2,957 posts)Now DOJ asserts the wad didnt even file his motion in the correct venue. In my judgment, based on my career as an attorney, this raises huge red flags about the judges impartiality. I would be pleased to be wrong of course, but when SCOTUS is so clearly biased it seems reasonable to watch his frontline judicial appointments every step very closely.

Just a fraction of that would establish a bias. In total, it is damning.

(1,685 posts)It doesnt look good when she came out with that initial statement about her intent to grant the special magistrate. The only good part of that might be that she said that to show that she was a loyal Republican goofball and then when the DOJ came back with their response shell be able to say well now that we see what came back from the DOJ well now Im not gonna grant the request because its so obvious what he was up to when he was obstructing justice or whatever.
Probably wishful thinking but maybe thats how it will turn out.

The other big difference is that Hillary had classified email, but Comey cited only three that he said were of concern and of those three one had a small (c) for Confidential beside a paragraph buried in the text and the others were classified after the fact. None of them were messages Hillary had initiated.

It isn't what hillary had received. It was at best confidential. Confidential is the lowest level of classification, and does not represent a threat to the nation. It is information the gov't deems as proprietary for a number of reasons, just like your company surely has. Personnel records are confidential. They are not state secrets.
It (the email issue) is a red herring inflated by the gop. A nothing burger with all the fury of the gop wurlitzer.
And lets not forget that the state department own email server WAS compromised, yet hillary's was not.

So when she received them, it was not classified, nor was it marked.

(26,064 posts)I only have a few lower-level personnel files in my office, most are on Workday, but there's stuff I have to keep for about 18 more months. No SSNs, etc., but they are in my locked office, in a locked cabinet. If my superiors saw me with teh files on my desk, I would be fired.

But if it was in his personal space, it would likely be constructive possession. He couldnt claim it wasn't in his posession.
