I'm not sure how this can even happen . The enforcement of immigration laws is solely a function of the federal government.
How does local law enforcement even determine the visa status of somebody ?
Aren't they supposed to transfer people to the border patrol if they think they have somebody in custody who might be illegally in the country?

(24,541 posts)Although they are run/funded by the federal govt, they are partnered with state and local governments, along with volunteers. They aren't "secure facilities". I guess you could compare them to homeless shelters or hurricane shelters. I don't know if the adult residents are free to come and go. Last year some of my friends got temporary jobs when they opened a center in town. It was at the local coliseum. I think the center is closed now.
After being held in a U.S. Customs and Border Protection facility for four days, he was taken to the Freeman Coliseum in San Antonio. Its one of 10 emergency shelters opened up by the Biden administration in Texas to house the large number of minors crossing the border without their parents.
It was also in the news last week after Abbott called for it to be shut down due to complaints received by the state of a lack of supervision, food and possible bullying and inappropriate behavior among teens.
Everything was good, Josue told a small group of reporters on Friday, describing his time in federal custody while sitting in the San Antonio office of the nonprofit Catholic Charities. They dont treat you badly.
The brown, thin boy with a head of trimmed curly hair said hes been treated well by both staff at the U.S. Customs and Border Protection facility and the San Antonio shelter run by the U.S. Department of Health and Human Services for boys ages 13 to 17 years old. But he said the San Antonio shelter had better beds and more food.

The boys who were interviewed were unaccompanied minors, so I don't think they were free to come and go. Abbott wanted the facility closed because he wanted our Biden sponsored center to look bad. So it was in the news. It was the Democratic Sheriff, Democratic County Commissioner, and our non-partisan mayor, who happens to be Democratic versus Greg Abbott.
It appears the immigrants being transported by Abbott and DeSantis are adults and any minors are with their parents. It's complicated.

In this case, the buses are going to host homes in other cities. They are not being dumped. Apparently, adults are allowed to get on commercial flights. I always thought their flights were charter.
However, here is an article about the immigrants who went to Martha's Vineyard. Sounds like they were out and about.

Migrants near the McDonalds parking lot across from the migrant resource center Thursday evening said they knew who Emmanuel was because he has been in the area for weeks picking up odd jobs. They said he had befriended some of the migrants who no longer had access to the center, but stuck around hoping to be hired for day labor.
Several said they heard Emmanuel tell other migrants that if they boarded the flight to Massachusetts, No te faltara nada, You wont need a thing. They declined to give a reporter their names.

Maybe what DeSantis did is not illegal??? Sketchy, shady, but not illegal
The DOJ can sue to halt these transports, but it's a gray area. It would be a civil procedure against Abbott or DeSantis. If DOJ sues, could it jeopardize legit transport of immigrants?
