(21,856 posts)Special counsel to the president Richard Sauber said a small number of documents with classified markings were discovered as Bidens personal attorneys were clearing out the offices of the Penn Biden Center, where the president kept an office after he left the vice presidency in 2017 until shortly before he launched his 2020 presidential campaign in 2019. The documents were found on Nov. 2, 2022, in a locked closet in the office, Sauber said.
Sauber said the attorneys immediately alerted the White House Counsels office, who notified the National Archives and Records Administration which took custody of the documents the next day.
Since that discovery, the Presidents personal attorneys have cooperated with the Archives and the Department of Justice in a process to ensure that any Obama-Biden Administration records are appropriately in the possession of the Archives, Sauber said.
A person who is familiar with the matter but not authorized to discuss it publicly said Attorney General Merrick Garland asked U.S. Attorney for the Northern District of Illinois John Lausch to review the matter after the Archives referred the issue to the department. John Lausch was appointed to his post by former President Donald Trump.

Also, what wes being stored? His VP schedule? Official Travel Documents
and Expense Reports? Personal correspondence as VP? Those items would be classified at a low level at the time they were applicable.
Not excusing anything, but there are levels of classification for documents, and an itinerary schedule identified as FOUO is definitely not the same as a TS-SCI communication document outlining asset resources.

I hope 100%, as someone who has Democratic blue blood in my veins, that this is no big deal. My intuition is telling me something different.
Especially since people tried to squelch the conversation - now that's the true mystery.

(115,659 posts)in the initial OP. However, I really don't think this is a big deal and that it will blow over. If the GOP does try to make a big deal of it they are implicitly admitting that TFG did something wrong, too - even worse because he took the documents intentionally, refused to give them back, lied about them, and didn't secure them. So after some initial huffing and puffing they'll probably decide to let the matter drop.

(115,659 posts)Of course the GOP can be expected to make a big fuss about it. But if they whine about how terrible it is, aren't they effectively admitting that it was also bad for TFG to do it? And even worse, because of instead of cooperating he refused to return the docs, hid some of them and claimed they were his? They'll have to tread very carefully when they go into whatabout mode on this.

This also helps Merrick Garland, in that they can't claim Garland is a partisan on a witch hunt against Republicans.

In a statement, Richard Sauber, special counsel to President Biden, said the White House is cooperating with the National Archives and the Justice Department on the matter.
"The documents were discovered when the president's personal attorneys were packing files housed in a locked closet to prepare to vacate office space at the Penn Biden Center in Washington, DC," Sauber said. Biden held a position at the center, run by the University of Pennsylvania, from 2017 to 2019.
The documents "were not the subject of any previous request or inquiry by the Archives," Sauber noted and were immediately handed over to the record-keeping agency.
