If the alleged crime was something like "taking classified docs" the taking occurred in D.C. But since "classified" has been muddied by the claim tRump can do it in his mind (but only while prez), it was strategic to charge with non-classified crimes to avoid that whole line of nonsense and delay, and they occurred in Florida. I have zero legal training. |

If I steal something from you in DC, I can be charged with theft in DC. But if I'm arrested for possessing stolen property in Florida or for lying to the authorities about the theft or conspiring to mislead law enforcement, I'm going to be charged where those acts took place

This was an awfully big risk to take. Wasn’t removing the documents from the White House the initial crime? That took place in DC, that’s where the case should be tried. Too late, though; looks like the fix is in and the American people lose again.

might do to help TFG skate by molding their ruling to help him specifically given the timing of things.
Smith v US Oral arguments were in late March. Ruling pending. |

Jack Smith war crimes prosecutor is not going to let some rinky dink judge bring this case down. They have mountains of evidence..one, and two as has been mentioned he would be well within his rights to ask for another judge. the 11th circuit would make that decision…oh and who was it that dressed her down the last time??

She can literally dismiss the entire case if she wants. He could appeal it, but it's questionable whether he will and whether they will grant the motion since the 11th Circuit didn't claim she was biased.

And what do you think the 11th circuit would say to her with the kind of evidence they have?. Prosecutors like smith in federal court regardless of biased judges have a 95+% rate of conviction

The Clerk of the Court says she's the Judge. I don't see the 11th Circuit removing her, because they didn't rule she was biased before, they just criticized her legal argument.
Now had the court said she showed extreme bias to the defendant, then I think it would be more likely. Keep in mind, the 11th Circuit is extremely conservative. They're not going to just kick her off the case because she screwed up before. |

22. The DC circuit, while in many ways very favorable to the prosecution in this case
has some very bad decisions in regard to venue in obstruction cases. I think he was stuck with Florida not sure what he can do about this judge.

You don’t think that the administration is incompetent. The Eeyore crowd is convinced that TFG is an evil genius and is racking up victories and nothing can convince them otherwise. If it wasn’t Cannon there would be another reason why Smith, who they were praising over the incompetent Garland, had fucked up.
These posters never have a good word about any of the people investigating the crimes, yet they can’t stop themselves from getting excited about how TFG is going to get off. And then double down whenever anyone points out how wrong they are. I find that curious. |

Aileen Cannon can literally dismiss the trial with prejudice arguing it violated Trump's rights, and it can't be appealed.
Or she can be more subtle and not allow a serious voire dire process to find unbiased jurors. Or she could refuse to allow certain testimony as evidence. |

65. A clerk is not going to permanently assign the judge in this case,
simply because that makes zero sense, the trial is too important.
I kept hearing that the judge to preside over the case would be randomly drawn and I have seen no evidence that happened. How many times has this law clerk assigned a judge? Is that the procedure? |

It’s my understanding from Lawrence O’Donnell that she wasn’t chosen, she’s there because she initially oversaw the case, as was the other judge..forget his name…the reasonable one

72. The Judges were drawn from a small pool that oversee West Palm Beach
Cannon is one of those judges and she got the case. So if you go by the "random wheel" argument about judicial assignments, there was about a 25% chance of her being the Judge and that's what happened.

75. I think Florida is correct venue. Florida is where the conduct occurred
and therefore Florida is where the venue should be. Got the short end of the stick when it comes to the judge, but Florida is where it has to be.

Under the District's rules, judges within the division, West Palm Beach, or a neighboring division (Fort Lauderdale division to the south; Fort Pierce division to the north) could have been assigned the case.
I'm pretty there sure there are more than 4 or 5 judges in these 3 divisions, but not much more. Maybe like 6 or 7. These are not very huge divisions. |
